3675 IIIIIIIIIIIllllllglllllllllliBIIIIillllllllBl~llllllllll ORDINANCE NO. 3675 AN ORDINANCE OF THE CITY OF SAN FORD, FLORIDA, VACATING AND RELOCATING AN EXISTING 14' UTILITY EASEMENT LYING BETWEEN FOREST DRIVE AND E. 25TM STREET AND BETWEEN WASHINGTON COURT AND MELLONVILLEAVENUE; PROVIDING FORSEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to vacate and relocate an existing 14' Utility Easement lying between Forest Drive and E. 25th Street and between Washington Court and Mellonville Avenue in the City of Sanford, Florida, and WHEREAS, a public hearing was held on October 22, 2001 for consideration and determination as to whether or not the vacating and relocating an existing 14' Utility Easement lying between Forest Drive and E. 25t~ Street and between Washington Court and Mellonville Avenue in the City of Sanford, Florida, should be allowed; and WHEREAS, the City Commission has determined that the vacating and relocating that certain 14' Utility Easement does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such vacating and relocating. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That a certain 14' Utility Easement lying between Forest Drive and E. 25th Street and between Washington Court and Mellonville Avenue in the City of Sanford, Florida, more particularly described as follows: SEE EXHIBIT "A" ATTACHED HERETO. be and the same is hereby vacated and relocated as more particularly described as FILE NUM 2001782756 " OR BOOK 04228 PAGE 0487 follows: SEE EXHIBIT "B" ATTACHED HERETO. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same ale hereby revoked.
