NATIONAL DRIVE EXTENDED SOUTHERLY AND S.
~ ~ ~ SANFORD AVENUE IN THE CI~ OF SANFORD, FLORIDA,
~ RESERVING A UTILITY EASEMENT OVER THE MOST
~ SOUTHERLY 500 FEET OF THE VACATED RIGHT-OF-
EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close, vacate
and abandon Mellonville Avenue lying be~een Noah Way extended easterly and Pine
Way and be~een Park National Drive extended southerly and S. Sanford Avenue in the
City of Sanford, Florida, rese~ing a utility easement over the most southerly 500 feet of
the vacated right-of-way; and
~ WHEREAS, a public hearing was held on November 26, 2001 for consideration and
determination as to whether or not the closing, vacating and abandoning Mellonville
Avenue lying be~een Noah Way extended easterly and Pine Way and be~een Park
National Drive extended southerly and S. Sanford Avenue in the City of Sanford, Florida,
should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and
abandoning of that ce~ain prope~y does not conflict with the Comprehensive Plan of the
City of Sanford, Florida. and that the public health, economy, comfo~, order, convenience,
and welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:

SECTION 1: That Mellonville Avenue lying between North Way extended easterly
and Pine Way and between Park National Drive extended southerly and S. Sanford
Avenue in the City of Sanford, Florida, more particularly described as follows:

be and the same is hereby closed, vacated, and abandoned; provided that the City shall
reserve an easement over the most southerly 500 feet of the vacated right-of-way.
SECTION 2: If any section or portion of a section of this ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
of any oth~i' section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and
the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its
passage and adoption.
