3699 ORDINANCE NO. 3699 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THE lO' NORTH-SOUTH UTILITY AND DRAINAGE EASEMENT LYING BETWEEN COASTLINE ROAD AND CHALLENGER COURT AND BETWEEN MARITIME DRIVE AND CENTRAL PARK DRIVE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon the North-South utility and drainage easement lying between Coastline Road and Challenger Court and between Maritime Drive and Central Park Drive in the City of Sanford, Florida, and WHEREAS, a public hearing was held on March 11, 2002, for consideration and determination as to whether or not the closing, vacating, and abandoning of the l O' North- South utility and drainage easement lying between Coastline Road and Challenger Court and between Maritime Drive and Central Park Drive in the City of Sanford, Florida, should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That the 10' North-South utility and drainage easement lying between CoaStline Road and Challenger Court and between Maritime Drive and Central Park Drive in the City of Sanford, Florida, more particularly described as follows: FILE NUN e001~85~!614 OR BOOK 0436~. PAGE 0655 That certain 10' utility and drainage easement lying between Lots 20 and 21 Sanford Central Park Phase II amended according to Plat Book 54, Pages 8, 9, and 10, less the North and South 10 Feet thereof, Public Records, Seminole County, Florida. be and the same is hereby closed, vacated, and abandoned. SECTION 2: The closing, vacating and abandoning action herein is subject to the issuance of a certificate of occupancy for the building addition. \ SECTION 3: If any section or portion of a section of this ordinance proves t,o be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 8= That this Ordinance shall become effective immediately upon the issuance of the Certificate of Occupancy for the building addition; if said Certificate of Occupancy is not issued this ordinance shall be null and void and of no force and effect.
