3713 ORDINANCE NO. 3713 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING THE CITY CODE OF SANFORD AND ESTABLISHING A POLICE OFFICER'S MORTGAGE ASSISTANCE PROGRAM; PROVIDING FOR LEGISLATIVE FINDINGS; PROVIDING FOR THE CREATION OF A PROGRAM FOR MORTGAGE ASSISTANCE TO CITY POLICE OFFICERS RESIDING IN THE CORPORATE LIMITS OF THE CITY OF SANFORD IN ORDER TO BENEFIT THE CITY BY MEANS OF THE PRESENCE AND ENHANCED RESPONSE TIMES OF POLICE OFFICERS; PROVIDING FOR IMPLEMENTATION OF THE POLICE OFFICER'S MORTGAGE ASSISTANCE PROGRAM BY MEANS OF ADOPTION OF A RESOLUTION BY THE CITY COMMISSION; PROVIDING FOR PERIODIC REVIEW; PROVIDING FOR SEVERABILITY, CONFLICTS, CODIFICATION AND EFFECTIVE DATE. WHEREAS, it is the desire of the City Commission of the City of Sanford to protect the health, safety and welfare of the citizens of the City of Sanford and to provide a secure environment for the families residing in the City of Sanford; and WHEREAS, SeL--'tion 187.07(7), Florida Statutes, sets forth a part of the State Comprehensive Plan and provides that it is a goal of the State of Flodda to "protect the public by preventing, discouraging, and punishing criminal behavior, lowering the highway death rate, and protecting lives and property from natural and manmade disasters"; and WHEREAS, Section 187.07(7), Florida Statutes, also provides that the following policies are adopted as official State policy: (a) Provide incentives to attract and retain high-quality law enforcement and correctional officers, (b) Emphasize the reduction of serious crime, particularly violent, organized, economic, and drug-related cdmes, (c) Increase the level of training and technical assistance provided to law enforcement agencies. (d) Increase crime prevention efforts to enhance the protection of individual personal safety and property; and WHEREAS, the presence of law enforcement personnel residing in communities serves many public purposes including enhanced law enforcement capabilities, providing sound role models within communities for youth, and to enable the City's law enforcement personnel to respond expeditiously to events and occurrences that necessitate public safety and law enforcement responses to protect the public health, safety and welfare. NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION t. Le.Qislative FindinQs. The City Commission of the City of Sanford finds and determines that it is in the public interest and serves a public purpose to create and establish a program whereby police officers of the City of Sanford are encouraged to reside within the corporate limits of the City of Sanford. The City Commission likewise finds that the expenditure of funds to encourage police officers of the City of Sanford to reside within the City of Sanford serves a valid and important public purpose. The City Commission further finds that the citizens of the City of Sanford will be greatly benefitted by City of Sanford police officers residing in City neighborhoods, being available to promptly address public safety emergencies as needed, and serving as positive role models to the children residing in the City of Sanford. The City Commission also finds that the Sanford Police Department Patrol Section is involved with Community Oriented Policing and the City's Community Policing is a collaborative effort between the police and the community that identifies problems of crime and disorder and involves all elements of the community in the search to resolve these problems. The Program will advance the goal of community policing and work to strengthen families and communities. The City Commission has concluded that the Program needs to be implemented in a manner that reflects highly upon police services and the value to residents of communities while also permitting Ordinance No. 3713 Page 2 administrative flexibility as needed to accomplish the day-to-day implementation of the Program. Additionally, the City Commission adopts the recitals to this Ordinance as part of its legislative findings pertaining to this Ordinance. SECTION 2. Creation of Police Officer's Mort_aaae Assistance Pro_aram. (a) There is hereby created and established a Police Officer's Mortgage Assistance Program. (b) The Program shall provide for specified monthly payments to eligible police officers who maintain their primary and permanent residence within the corporate limits of the City of Sanford. SECTION 3. Implementation of Police Officer's Mortaa_oe Assistance Prooram. The Police Officer's Mortgage Assistance Program shall be implemented by the City Commission of the City of Sanford by means of the adoption of a resolution specifically detailing the terms, conditions, limitations, and benefits of the Program. Said resolution may be amended from time-to-time by the City Commission to address the policies and administrative practices and mechanisms pertaining to the Program. SECTION 4. Periodic Review of Police Officer's Mortgaoe Assistance Pro_or-am. The City Commission shall periodically review the Police Officers Mortgage Assistance Program as may be deemed appropriate. SECTION 5, Severability.~ if any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional it shall not be held to impair the validity, force or effect or any other section or part of a section of this Ordinance. SECTION 6. Conflicts. All ordinances or pads of ordinances in conflict herewith be and the same are hereby repealed. SECTION 7. Codification. it is the intention of the City Commission of the City of Sanford, Florida, and it is hereby ordained that the provisions of this Ordinance shaft become and Ordinance No. 3713 Page 3 be made a part of the Code of Ordinances of the City of Sanford, Florida; that the Sections of this Ordinance may be renumbered or re-lettered to accomplish such intention; that the word, "Ordinance," may be changed to "Section ," "Article," or other appropriate word; provided, however, that Sections 5, 6, 7 and 8 shall not be codified. SECTION 8. Effective Date. Except as otherwise provided herein, this Ordinance shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this/~:>"7~ day of ~f//"~(~ ,2002.
