AN ORDINANCE OF THE CITY OF SANFORD, FLORiDA~
AMENDING CHAPTER 18, OFFENSES AND MISCELLANE-
OUS PROVISIONS~ ARTICLE I, IN GENERAL,
SECTION 18-18, LOUD AND UNNECESSARY NOISES
PROHIBITED; ENUMERATED; EXCEPTION, PARAGRAPH
(10), CONSTRUCTION OR REPAIRING OF BUILDINGS,
OF THE SANFORD CITY CODE, BY AMENDING THE
TIMES OF CONSTRUCTION AND REPAIRS, PROVIDING
FOR SEVERABILITY, CONFLICTS AND EFFECTIVE
DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION 1. That Chapter 1.8, Offenses and Miscellaneous
Provisions, Article I, In General~ Section 18-18, Loud and
Unnecessary Noises Prohibited; Enumerated: Exception, Paragraph
(10), Construction or Repairing of Buildings of the Sanford City
Code, shall be amended to read as follows:
(10) Construction or repairing of buildings. The
erection (including excavating), demolition, alteration or repair
of any building other than between the hours of 7:00 a.m. and
7:00 p.m. on weekdays and 8:00 a.m. and 7:00 p.m. on Saturdays
and Sundays, except in case of urgent necessity in the interest
of public health and safety, and then only with a permit from the
building inspector~ which permit may be granted for a period not
to exceed three (3) days or less while the emergency continues
and which permit may be renewed for periods of three (3) days or
less while the emergency continues. If the building inspector
should determine that the public health and safety will not be
impaired by the erection, demolition, alteration or repair of any
building or the excavation of streets and highways between the
hours of 7:00 p.m. and 7:00 a.m. on weekdays, and 7:00 p.m. and
8:00 aom. on Saturdays and Sundays, and if he shall further
determine that loss or inconvenience would result to any party in
interest, he may grant permission for such work to be done
between the hours of 7:00 p.m. and 7:00 a.m. weekdays, and 7~00
p.m. and 8:00 a.m. on Saturdays and Sundays, upon application
being made at the time the permit for the work is awarded or
during the progress of the work.
SECTION 2: If any section or portion of a section of
this ordinance proves to be invalid, unlawful or unconstitu-
tional, it shall not be held to impair the validity, force or
effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby revoked.
SECTION 4: That this ordinance shall. become effective
immediately upon its passage and adoption°
