Box 1778, Sanford, FL 32772-1778o ORDINANCE NO. 1743 AN ORDi~ANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A NORTH-SOUTH ~,T.T.RY LYING BETWEEN llTH STREET AND 12TH STREET AND BETWRRN HOLLY AVENUE AND MAPLE AVENUE, RESERVING A FfILITY EASEMENT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECT~ DATE WHEREAS, the owners of that certain real property abutting the North-South alley lying between llth Street and 12 Street and between Holly Avenue and Maple Avenue, applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on February 11, 1985, for consideration and determination as to whether or not the closing, vacating and abandoning of that certain portion should be allowed; and WHEREAS, the City Cammission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Camprehensive Plan of the City of Sanford, Florida, and that the public health, econamy, camfort, order, convenience and welfare will be prcmoted ~by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE. CITY OF SANFORD, FLO~ZDA: SECTION 1: That a portion of a North-South alley lying between 'llth Street and 12th Street and betwen Holly Avenue and Maple Avenue, more particularly described as follows: That certain North-South alley lying between Lots 1 through 5 and Lots 6 through 10, Block 13, Tier 10 ~ Florida Land and Colonization Campany Limited E. R. Trafford's Map of the Town of Sanford, Plat Book 1, Pages 56-64, Public Records of Seminole County, Florida° be and the same is hereby closed, vacated and abandoned, providing however that the City hereby reserves a utility easement over said property. SECTICoN 2: If any section or portion of a sect/on of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict here~ith, be and the same are hereby repealed.
