3718 ORDINANCE NO. 3718 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3079 OF SAID CITY; SAID ORDINANCE BEING THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP DESIGNATION OF APPROXI MATELY 0.165 + ACRE OF PROPERTY LYING BETWEEN U.S. 17192 AND NARCISSUS AVENUE AND BETWEEN RAND YARD EXTENDED NORTHERLY AND AIRPORT ROAD EXTENDED NORTHERLY, FROM INDUSTRIAL, TO WATERFRONT DOWNTOWN BUSINESS DISTRICT; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Sanford's Planning and Zoning Commission, as the City's local planning agency, held a public hearing on June 6, 2002, to consider amending the Future Land Use Map designation from Industrial to Waterfront Downtown Business District, and WHEREAS, the City Commission as the City's governing body, held a public hearing on June 24, 2002, to consider amending the Future Land Use map designation from Industrial to Waterfront Downtown Business District, and WHEREAS, the City of Sanford has complied with requirements and procedures to amend adopted comprehensive plans as set forth in Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That portion of the Future Land Use Plan Element referenced as the Future Land Use Map is hereby amended by changing the designation of approximately 0. 165 + acre of property lying between U.S. 17/92 and Narcissus Avenue and between Rand Yard extended northerly and Airport Road extended northerly, from Industrial to Waterfront Downtown Business District. Said property being more specifically described as follows: SEE EXHIBIT "A" ATTACHED HERETO. A copy of the amendment to the Future Land Use Map is attached hereto and by this reference incorporated herein as Exhibit "B" and hereby adopted pursuant to Florida Statutes. SECTION 2: Severability. If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3 Conflicts: That all ordinances or resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of any conflict. SECTION 4 Effective Date: The effective date of this Ordinance shall be thirty-one (31) days after its date of adoption. If challenged within thirty (30) days after adoption, this Ordinance shall not become effective until the state land planning agency or the Administration Commission, respectively, issues a final order determining this Ordinance in compliance with Chapter 163, Part II, Florida Statutes.
