3723 ORDINANCE NO. 3723 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3079 OF SAID CITY; SAID ORDINANCE BEING THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP DESIGNATION OF 1.42 + ACRES OF PROPERTY LYING BETWEEN W. 11TH STREET AND W. 12TH STREET AND BETWEEN MAPLE AVENUE AND HOLLY AVENUE, FROM MDR-15, MEDIUM DENSITY RESIDENTIAL, TO GC, GENERAL COMMERCIAL; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Sanford's Planning and Zoning Commission, as the City's local planning agency, held a public hearing on June 20, 2002, to consider amending the Future Land Use Map designation from Medium Density Residential to General Commercial, and WHEREAS, the City Commission as the City's governing body, held a public hearing on July 8, 2002, to consider amending the Future Land Use map designation from Medium Density Residential to General Commercial, and WHEREAS, the City of Sanford has complied with requirements and procedures to amend adopted comprehensive plans as set forth in Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That portion of the Future Land Use Plan Element referenced as the Future Land Use Map is hereby amended by changing the designation of 1.42 + acres of property lying between W. 11 th Street and W. 12 Street and between Maple Avenue and Holly Avenue, from Medium Density Residential to General Commercial. Said property being more specifically described as follows: LOTS 1 TO 10 AND VACATED ALLEY BETWEEN BLK 13, TIER 10 TOWN OF SANFORD AS RECORDED IN PLAT BOOK 1, PAGE 57, PUBLIC RECORDS SEMINOLE COUNTY, FLORIDA. A copy of the amendment to the Future Land Use Map is attached hereto and by this reference incorporated herein as Exhibit "A" and hereby adopted pursuant to Florida Statutes. SECTION 2: Severability. If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3 Conflicts: That all ordinances or resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of any conflict. SECTION 4 Effective Date: The effective date of this Ordinance shall be thirty-one (31) days after its date of adoption. If challenged within thirty (30) days after adoption, this Ordinance shall not become effective until the state land planning agency or the Administration Commission, respectively, issues a final order determining this Ordinance in compliance with Chapter 163, Part II, ~a Statutes.
