3777 BK ~7~0 PG 1838 CLERK' S ~ 200305~536 ORD~N~NG~ NO. 3~ ~ ~a~ ~ AN ORDINANCE OF THE CI~ OF SANF~~, CLOSING, VACATING, AND ABANDONING THAT CERTAIN FOURTEEN FOOT WIDE NORTH-SOUTH ALLEY AND THAT CERTAIN FOURTEEN FOOT WIDE ~ST-WEST ALLEY LYING BE~EEN COMMERCIAL STREET AND 1ST STREET AND BE~EEN LAUREL AVENUE AND U.S. H~. 17'92; PROVIDING FOR SEVE~BILI~, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon that certain fourteen (14) foot wide north-south alley and that certain fourteen (14) foot wide east-west alley lying between Commercial Street and 1st Street and between Laurel Avenue and U.S. 17-92; and WHEREAS, a public hearing to be held on March 10, 2003, for consideration and determination as to whether or not the closing, vacating and abandoning of that certain fourteen (14) foot wide north-south alley and that certain fourteen (14) foot wide east-west alley lying between Commercial Street and 1st Street and between Laurel Avenue and U.S. 17-92, should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That that certain fourteen (14) foot wide north-south alley and that FILE NUN ~5~536 OR BO014 ~4768 PAGE 1~,~9 certain fourteen (14) foot wide east-west alley lying between Commercial Street and 1st Street and between Laurel Avenue and U.S. 17-92, more particularly described as follows: (SEE EXHIBIT "A" ATTACHED HERETO) be and the same is hereby closed, vacated, and abandoned. SECTION 2: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. SECTION 3: That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby revoked.
