3908ORDINANCE NO. 3908 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3079 OF SAID CITY; SAID ORDINANCE BEING THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP DESIGNATION OF APPROXIMATELY 6.26 ACRES OF PROPERTY LYING BETWEEN OAK VIEW PLACE EXTENDED EASTERLY AND W. LAKE MARY BOULEVARD AND BETWEEN ART LANE AND STERLING PINE STREET; DESIGNATING 4.56 ACRES FROM LDR-SF, LOW DENSITY RESIDENTIAL SINGLE FAMILY, TO MDR-10, MEDIUM DENSITY RESIDENTIAL AND 1.7 ACRES FROM LDR-SF, LOW DENSITY RESIDENTIAL SINGLE FAMILY TO RP, RESOURCE PROTECTION; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Sanford's Planning and Zoning Commission, as the City's local planning agency, held a public hearing on December 2, 2004, to consider amending the Future Land Use Map designating 4.56 acres from LDR-SF, Low Density Residential Single Family to MDR-10, Medium Density Residential and 1.7 acres from LDR-SF, Low Density Residential Single Family to RP, Resource Protection; and WHEREAS, the City Commission as the City's governing body, held a public hearing on December 27, 2004, to consider amending the Future Land Use Map designating 4.56 acres from LDR-SF, Low Density Residential Single Family to MDR-10, Medium Density Residential and 1.7 acres from LDR-SF, Low Density Residential Single Family to RP, Resource Protection; and WHEREAS, the City of Sanford has complied with requirements and procedures to amend adopted comprehensive plans as set forth in Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That portion of the Future Land Use Plan Element referenced as the Future Land Use Map is hereby amended by changing the designation of approximately 6.26 acres of property lying behveen Oak View Place extended easterly and W. Lake Mary Boulevard and between Art Lane and Sterling Pine Street, designating 4.56 acres from LDR-SF, Low Density Residential Single Family, to MDR-10, Medium Density Residential and 1.7 acres from LDR-SF, Low Density Residential Single Family, to RP, Resource Protection. Said property being more specifically described as follows: SEE ATTACHED EXHIBIT "A" A copy of the amendment to the Future Land Use Map is attached hereto and by this reference incorporated herein as Exhibit "B' and hereby adopted pursuant to Florida Statutes. SECTION 2: SEVERABILITY. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force, or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. SECTION 3; CONFLICTS. All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of any conflict. O~inanceNo. 3908 ~ ~ The effective date of this Ordinance shall be thirty-one (31) days after its date of adoption. If challenged within thirty (30) days after adoption, this Ordinance shall not become effective until the state land planning agency or the Administration Commission, respectively, issues a final order determining this Ordinance in compliance with Chapter 163, Part II, Florida Statutes.
