3923ORDINANCE NO. 3923 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING ORDINANCE NO. 3079 OF SAID cl'rY; SAID ORDINANCE BEING THE COMPREHENSIVE PLAN; AMENDING THE FUTURE LAND USE MAP DESIGNATION OF 9.92 ACRES OF PROPERTY LYING BETWEEN RINEHART ROAD AND OREGON AVENUE AND BETWEEN LOWE AVENUE AND RINEHART ROAD; FROM HIPTI, HIGH INTENSITY PLANNED DEVELOPMENT TARGET INDUSTRY, AND HI, HIGH INTENSITY, TO WIC, WESTSIDE INDUSTRY AND COMMERCE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Sanford's Planning and Zoning Commission, as the City's Jocal planning agency, held a public hearing on Mamh 3, 2005, to consider amending the Future Land Use Map designation from HIPTI, High Intensity Planned Development Target Industry, and HI, High Intensity, to WIC, Westside Industry and Commerce; and WHEREAS, the City Commission as the City's governing body, held a public hearing on March 28, 2005, to consider amending the Future Land Use Map designation from HIPTI, High Intensity Planned Development Target Industry, and HI, High Intensity, to WIC, Westside Industry and Commerce; and WHEREAS, the City of Sanford has cornplied with requirements and procedures to amend adopted comprehensive plans as set forth in Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: ~ That portion of the Future Land Use Plan Element referenced as the Future Land Use Map is hereby amended by changing the designation of 9.92 acres of property lying between Rinehart Road and Oregon Avenue and between Lowe Avenue and Rinehart Road, from HIPTI, High Intensity Planned Development Target Industry, and HI, High Intensity, to WIC, VVestside Industry and Commerce. Said property being more specifically described as follows: LEG LOT 5 SELY OF RINEHART RD (LESS SR 417 R/W DESC ORB 367611189) PINE LAKE GROVES PB 9 PG 27 AND BEG INT OF ELI OF LOT 10 PINE LAKE GROVES & SLY R/W OF RINEHART RD RUN S 115.07 FT N 27 DEG 19 MIN 10 SEC W 101.94 FT NELY ON CURVE 51.26 FT TO BEG (LESS RD) PINE LAKE GROVES PB 9 PG 27 A copy of the amendment to the Future Land Use Map is attached hereto and by this reference incorporated herein as Exhibit "A" and hereby adopted pursuant to Florida Statutes. ~ ~ If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force, or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. SECTION 3: CONFLICTS. All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of any conflict. ~ ,~J~[YJ~ The effective date of this Ordinance shall be thirty-one (31) days after its date of adoption. If challenged within thirty (30) days after adoption, this Ordinance shall not become effective until the state land planning agency Ordinance No. 3923 or the Administration Commission, respectively, issues a final order determining this Ordinance in compliance with Chapter 163, Part II, Florida Statutes.
