3945ORDINANCE NUMBER 3945 CITY OF SANFORD, FLORIDA AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, PROVIDING FOR METER SET CHARGES AND SEWER TAP CHARGES; AMENDING BY SUBSTANTIAL REWORDING SECTION 28-48 OF THE CITY OF SANFORD CODE; PROVIDING FOR THE CREATION AND ESTABLISHMENT OF AN ALTERNATIVE WATER SUPPLY PROGRAM; PROVIDING FOR INSTRUCTIONS TO THE CODE CODIFIER PERTAINING TO TERMINOLOGY RELATIVE TO RECLAIMED WATER FACILITIES AND ALTERNATIVE WATER SUPPLY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ENACTED BY THE CITIZENS OF THE CITY OF SANFORD, FLORIDA: SECTION 1. REVISED METER SET AND TAP CHARGES. Section 28-48 of the City ~$at~ord Code ~s substantially reworded to read as follows: Sec. 28-48. Meter charges and sewer tap chares. (a). The charges set forth in Subsection (a) relate to standard field conditions with a line depth of three (3) feet. Deeper lines and abnormal situations may results in higher costs as determined by the Utility Department based upon the particular circumstances of the installation. The costs set forth in Subsection (a) may not apply with regard to installations pertaining to non- residential uses. (c). Customers are responsible for installing a potable water back-flow prevention device for all potable meters larger than one (1) inch and any and all costs relating thereto. SECTION 2. ALTERNATIVE WATER SUPPLY PROGRAM. Section 28-152.1.1 of the City of Sanford Code is hereby created to read as follows: Sec. 28-152.1.1 Alternative Water Supply Program Creation And Purpose The City of Sanford Alternative Water Supply (AWS) Program is hereby created and established. AWS include reclaimed water, stormwater, shallow wells and brackish water. The primary function of AWS is irrigation for customers of the City. Developments that are not required to connect to an existing reclaimed water line and which choose not to connect shall be required to connect to an AWS source for irrigation purposes. Such connections will be in accordance with City's land development regulations (Schedule P). SECTION 3. RECLAIMED AND ALTERNATIVE WATER SUPPLY CODE CODIFIER INSTRUCTIONS. The Code codifier is hereby instructed and directed to make conforming changes in all sections of the City of Sanford Code to ensure that references to the phrases "reclaimed water facility/ies' or "reclaimed water irrigation system" or similar words and phrases be supplemented and revised to include the words "and alternative water supply" or similar words or phrases as appropriate in the context. SECTION 4. CONFLICTS. All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed. SECTION 5. SEVERABILITY. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. SECTION 6. PENALTIES. The City may enforce the provisions of this Ordinance by any and all means available under Florida law and may seek any and all legal remedies available under Florida law. 2 SECTION 7,CODIFICATION. It is the intention of the City Commission of the City of Sanford, Florida, and it is hereby ordained that the provisions of this Ordinance as set forth in the Exhibit shall become and be made a pan of the Code of Ordinances of the City of Sanford, Florida; that the Sections of this Ordinance may be renumbered or re-entered to accomplish such intention; that the word, "Ordinance," may be changed to "Section," "Article," or other appropriate word; provided, however, that Sections 3, 4. 5, 6, 7 and 8 shall not be codified. SECTION 8. EFFECTIVE DATE. This Ordinance shall take immediate effect upon enactment. PASSED and ADOPTED this 25th day of July, 2005.
