3968ORDINANCE NUMBER 3968 cl'rY OF SANFORD, FLORIDA AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SANFORD, FLORIDA, PROVIDING FOR THE REVISION OF SECTION 2-63 OF THE CODE OF ORDINANCES OF THE CITY OF SANFORD PERTAINING TO TRAVEL EXPENSES; PROVIDING FOR DELEGATION TO THE CITY MANAGER; PROVIDING FOR INCORPORATION OF RULES RELATING TO OFFICIAL BUSINESS TRAVEL INTO THE CITY'S HUMAN RESOURCES MANUAL; PROVIDING FOR CONFLICTS; PROVIDING FOR NO AFFECT ON THE RIGHTS OF UNION MEMBERS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. AMENDMENT TO SECTION 2-63 CODE OF ORDINANCES OF THE CITY OF SANFORD. Section 2-63 of the Code of Ordinances of the City of Sanford is amended and substantially reworded to read as follows: Sec. 2-63. Travel expenses. Payment for per diem, mileage and meals for officials and employees of the City shall be in such amounts as are provided as set forth in policies and procedures adopted by the City Manager and published in the City's Human Resources Manual; provided, however, that the City Manager shall be guided by the rates and benefits provided by Seminole County Govemment and other local governments located within Seminole County. SECTION 2. DELEGATION TO CITY MANAGER/INCLUSION INTO HUMAN RESOURCES MANUAL. (a). The Mayor and the City Commission of the City of Sanford hereby delegate to the City Manager the authority to take any and all actions necessary and expedient, as may be appropriate in his sound and professional discretion, in order to implement the provisions of this Ordinance. (b). The actions of the City Manager taken pursuant to the provisions of this Ordinance shall be published in a revised and amended Human Resources Manual (by whatever title). SECTION 3. SAVINGS RELATING TO UNION CONTRACTS - COLLECTIVE BARGAINING AGREEMENTS/CONFLICTS WITH OTHER ORDINANCES - CODE PROVISIONS. (a). The provisions of this Ordinance shall not, in any way, affect the rights of City employees who are employed by the City subject to the provisions of a collective bargaining agreement. (b). All conflicting provisions of the Code of Ordinances of the City of Sanford are hereby repealed. In the event of any conflict with any other provision of the Code of Ordinances of the City of Sanford or any other ordinance of the City, the provisions of this Ordinance shall prevail. SECTION 4. SEVERABILITY. If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, the invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are declared severable. SECTION 5. CODIFICATION. It is the intention of the City Commission of the City of Sanford, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Sanford; provided, however, that the provisions of Sections 3, 4, 5 and 6 shall not be codified. SECTION 6. EFFECTIVE DATE. This Ordinance shall become effective immediately upon its enactment. PASSED and ADOPTED this 9th day of January, 2006.
