3775 ORDINANCE NO. 3775 CLERK' AN ORDINANCE OF THE CI~ OF SANF~~ CLOSING, VACATING, AND ABANDONIN~,I~r WIDE EAST-WEST RIGHT-OF-WAY EIGHT FOOT ALLEYS BETVVEEN MAGNOLIA AVENUE AND PALMETTO AVENUE AND A FOURTEEN FOOT NORTH-SOUTH ALLEY BETWEEN 14TH STREET AND EAST 15TH STREET, SUBJECT TO RESERVING A CITY SERVICES EASEMENT, PROHIBITING VEHICULAR ACCESS WITHOUT CITY APPROVAL, AND RETAINING A UTILITY EASEMENT; PROVIDING FOR SEVERABILI'rY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon a fifty foot wide east-west right-of-way and adjoining eight foot alleys between Magnolia Avenue and Palmetto Avenue and a fourteen foot north-south alley between 14th Street and East 15th Street; and WHEREAS, a public hearing to be held on March 10, 2003, for consideration and determination as to whether or not the closing, vacating and abandoning a fifty foot wide east-west right-of-way and adjoining eight foot alleys between Magnolia Avenue and Palmetto Avenue and a fourteen foot north-south alley between 14th Street and East 15th Street, reserving a City Services Easement, prohibiting vehicular access without City approval, and retaining a utility easement, should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF FILE NUM 2003052537 OR BOOK 04760 PAGE 1844 SANFORD, FLORIDA: SECTION 1: That a fifty foot wide east-west right-of-way and adjoining eight foot alleys between Magnolia Avenue and Palmetto Avenue and a fourteen foot north-south alley between 14th Street and East 15th Street, more particularly described as follows: (SEE EXHIBIT "A" ATTACHED HERETO) be and the same is hereby closed, vacated, and abandoned, subject to the reserving a City Services Easement, and prohibiting vehicular access without City approval over parcel A, and retaining a utility easement over the right-of-way of parcel B. SECTION 2: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. SECTION 3: That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby revoked.
