3808 ORDINANCE NO. 3808 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THAT CERTAIN FOURTEEN FOOT ALLEY LYING BETWEEN EAST 28TM PLACE AND EAST 29TM STREET AND BETWEEN PALMETTO AVENUE AND MAGNOLIA AVENUE, RESERVING A UTILITY EASEMENT WITH CONDITIONS; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abando!n that certain fourteen (14) foot wide alley lying between East 28t~ Place and East 29th Street and between Palmetto Avenue and Magnolia Avenue; and WHEREAS, a public hearing was held on September 8, 2003, for consideration and determin~ion'as to whether or not the closing, vacating and abandoning of that certain fourteen (14) foot alley lying between East 28~ Place and East 29t~ Street and between Palmetto Avenue and Magnolia Avenue, should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That that certain fourteen (14) foot wide alley lying between East 28th Place and East 29th Street and between Palmetto Avenue and Magnolia Avenue, more particularly described as follows: M~I~¥~ M~RS~, CL~RK Lm¢ CIRCUIT i~01JR'I' ~M)N()LE L13JNTy BK 05036 PG 1593 CLERK'S # 2003173385 RELQRI)IN8 F£E~ RECDROED BY L McKinley FILE NUM 2003173385 OR BOOK 05036 PAGE 1594 THAT CERTAIN 14' ALLEY LYING BET~NEEN LOTS 1-5 AND 6-10, BLOCK 2, ROSALIND HEIGHTS, PB 3, PG 47, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA be and the same is hereby closed, vacated, and abandoned, reserving a utility easement over said alley with no construction allowed (with the exception of utility related upgrades and maintenance), and said alley shall remain open for vehicular access. SECTION 2: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. SECTION 3: That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby revoked.
