AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING THAT CERTAIN
SIXTY-SlX FOOT WIDE NORTH-SOUTH RIGHT-OF-WAY OF
OLEANDER AVENUE LYING BETWEEN MEDICAL PLAZA
DRIVE AND W. SR 46 AND BETWEEN N. MANGOUSTINE
AVENUE AND N. JESSAMINE AVENUE, RESERVING SAME
AS A DRAINAGE AND UTILITY EASEMENT; PROVIDING
FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, an application has been filed with the City of Sanford to close, vacate
and abandon that certain sixty-six (66) foot wide north-south right-of-way of Oleander
Avenue lying between Medical Plaza Drive and W. SR 46 and between N. Mangoustine
Avenue and N. Jessamine Avenue; and
WHEREAS, a public hearing was held on June 14, 2004, for consideration and
determination as to whether or not the closing, vacating and abandoning of that certain
sixty-six (66) foot wide north-south right-of-way of Oleander Avenue lying between Medical
Plaza Drive and W. SR 46 and between N. Mangoustine Avenue and Jessamine Avenue
should be allowed; and
WHEREAS, the City Commission has determined that the closing, vacating and
abandoning of that certain property does not conflict with the Comprehensive Plan of the
City of Sanford, Flodda, and that the public health, economy, comfort, order, convenience,
and welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA: ~,

~ That certain sixty-six (66) foot wide north-south right-of-way of
Oleander Avenue lying between Medical Plaza Drive and W. SR 46 and between N.
Mangoustine Avenue and N. Jessamine Avenue, more particularly described as follows:
ALL THAT PART OF OLEANDER AVENUE LYING SOUTH OF THE
SOUTH LINE OF COMMERCIAL STREET IMMEDIATELY EAST OF
BLOCK 2, TIER 18 AND WEST OF BLOCK 2, TIER 17, ST.
GERTRUDE ADDITION TO THE TOWN OF SANFORD, AS
RECORDED IN PLAT BOOK 1, PAGES 112, 113, 116 AND 117, OF
THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, AND
LYING NORTH OF THE NORTH RIGHT OF WAY LINE OF STATE
ROAD 46, SECTION 77030.
be and the same is hereby closed, vacated, and abandoned, reserving same as a drainage
and utility easement.
~ If any section or portion of a section of this Ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
of any other section or part of this Ordinance.
~ That all Ordinances or parts of Ordinances in conflict herewith be and
the same are hereby revoked.
~ That this Ordinance shall become effective immediately upon its
passage and adoption.
