3880ORDINANCE NO. 3880 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING THAT CERTAIN PORTION OF AMERICANA BOULEVARD LYING BETWEEN EAST AIRPORT BOULEVARD AND LOGAN HEIGHTS CIRCLE EXTENDED EASTERLY AND BETWEEN THE CENTRAL FLORIDA GREENEVVAY AND ORLANDO DRIVE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, an application has been filed with the City of Sanford to close, vacate and abandon that certain portion of Americana Boulevard lying between East Airport Boulevard and Logan Heights Circle extended easterly and between the Central Florida Greeneway and Orlando Drive; and WHEREAS, a public hearing was held on June 28, 2004, for consideration and determination as to whether or not the closing, vacating and abandoning of that certain portion of Americana Boulevard lying between East Airport Boulevard and Logan Heights Circle extended easterly and between the Central Florida Greeneway and Orlando Drive should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: ~ That certain portion of Americana Boulevard lying between East Airport Boulevard and Logan Heights Circle extended easterly and between the Central Florida Greeneway and Orlando Drive, more particularly described as follows: SEE ATTACHED EXHIBIT "A" be and the same is hereby closed, vacated, and abandoned. ~ If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. ,~E_O_TJ_O_J~L~3~ That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby revoked. ~ That this Ordinance shall become effective immediately upon its passage and adoption.
