Reason for Change: In lieu of the standard 6' high fence that was specified, a higher fence
(10') is proposed to be installed adjacent to the basketball courts.

Description of Change: Upgrade 6th St. Culvert Crossing at Cloud Branch
Reason for Change: The 6 th St, crossing of Cloud Branch is undersized and has been part
of the approved planning documents under the State Revolving Fund
(SRF) Loan program and was part of the St. Johns River Water
Management District (SJRWMD) permit. Construction was not part
of the initial project for Cloud Branch due to the contamination in the
ditch north of 6 th St. that has been cleaned as part of the Former
Sanford Gasification Plant (SGP) Remediation project. Due to the
proposed reconstruction of 6 th St. as part of the SGP project, it is
recommended that the 6 th St. culvert crossing be upgraded with a
proposed new double 5' x 12' concrete box culvert. Since the 6 th St.
project was part of the approved SRF loan documents, SRF funding
is available for the culvert replacement. Associated with the culvert
replacement are sanitary sewer replacement at the crossing and the
installation of new guardrail at 6 th St. and 8 th St. at the open Cloud
Branch channel, as needed for safety.
Change in Contract Price: $326,038.98

ITEM 6
Description of Change: Time To Allow For 6th St. Crossing Design, Pricing, Commission
Approval
Reason for Change: The substantial completion date for the current Cloud Branch
construction is 8/31/10. Time is needed to allow for surveying and
designing the crossing, including the preparation of construction
drawings, developing construction quantities and pricing, including
reviewing proposed prices presented by the Contractor, and
obtaining Commission approval of the proposed work. The proposed
time, when added to 8/31/10 results in a construction start of
11/15/10. Should the Commission approve this proposed change

order, and the Contractor complete its closeout of the current Cloud
Branch project prior to 11/15/10, then the Contractor would be
allowed to start work prior to 11/15/10, as authorized by the City.

WAIVER This Change Order constitutes full and mutual accord and satisfaction for the
adjustment of the Contract Price and Contract Time as a result of increases or decreases in cost
and time of performance caused directly and indirectly from the change. Acceptance of this
Waiver constitutes an agreement between OWNER and CONTRACTOR that the Change Order
represents an equitable adjustment to the Agreement and that CONTRACTOR shall waive all
rights to file a Contract Claim or claim of any nature on this Change Order. Execution of this
Change Order shall constitute CONTRACTOR's complete acceptance and satisfaction that it is
entitled to no more costs or time (direct, indirect, impact, etc.) pursuant to this Change Order.

SUBJECT: Increase funds for the Cloud Branch Phase II Drainage project.
SYNOPSIS:
Approve application for a State Revolving Fund (SRF) Companion Loan, change order
#3 to Central Florida Environmental (CFE) Corp., increase purchase orders to CPH
Engineers and Ardaman and Associates is requested.
FISCAL/STAFFING STATEMENT:
The total amount requested is $496,333 and will be funded through an SRF Companion
Loan through the Stormwater Utility fund.
BACKGROUND:
The City Commission approved the Cloud Branch Drainage Improvement Project
Phase II to be funded through the State Revolving Fund (SRF) with American
Recovery and Reinvestment Act (ARRA) stimulus funding. Near completion of this
project staff met with CPH Engineers to determine if funding would be available to
complete the box culvert road crossing at W. 6th Street north of the existing project. In
conjunction with the work being completed at the Sanford Gasification site this will
complete all of the proposed stormwater improvements for the north end of the Cloud
Branch Drainage system. Staff discussed additional funding through SRF and their
grant administrator stated the project was eligible for a companion loan associated with
the existing Cloud Branch Phase II project.
The change order to CFE Corporation is to replace an existing 5'x12' box culvert with
a double 5' x 12' box culvert across W. 6 Street. The existing crossing is undersized
and would not sustain an abnormal rain event at this location.
CPH Engineers increase is for additional design, engineering, permitting and grant
application over -site of the original drainage plan.
Ardaman and Associates' purchase order is to install and monitor six 2" wells and
extract one water sample per Florida Department of Environmental Protection
requirements for the new pond at Coastline Park.
LEGAL REVIEW:
All contracts are being reviewed by the City Attorney for content, awaiting approval.
RECOMMENDATION:
It is staff's recommendation that the City Commission approve the application for the
SRF loan, change order #3 to CFE, increase purchase orders to CPH Engineers for
continuing design services and to Ardaman and Associates for well installation and
monitoring.
SUGGESTED MOTION:
"I move to approve the application for the SRF Loan in the amount of $496,333,
change order #3 to CFE for $314,890.80 and increasing purchase orders to CPH
Engineers for $64,670 and Ardaman and Associates for $32,401."
