223 - School Zone MaintenanceSCHOOL ZONE MAINTENANCE INTER-LOCAL AGREEMENT
1995, by and between SEMINOLE COUNTY, a political subdivision of the State of
Florida (hereinaiter referred to as "CoUnty") and the CITY OF SANFORD, a Florida
municipal corporation (hereinafter referred to as "City).
WITNESSETH:
WHEREAS, Florida law provides for Inter-Local agreements between cities and
counties for the performance of their respective administrative and service functions;
and
WHEREAS, the City and the County desire, pursuant to Chapter 163 of the
Florida Statutes, to enter into an Inter-Local Agreement whereby the County will
maintain all school zone signs and markings installed by the County on City streets
where currently existing, or as identified by the City, subject to confirmation by the
County.
NOW, THEREFORE, in consideration of the mutual covenants herein contained, it
is agreed as follows:
The County will maintain within the City all school zone signing and
markings installed on City streets by the County to the extent of the
County's capability in terms of ordinary repairs and availability of
materials.
In consideration of the Countyts performing services covered her.in,
City agrees that County's performance her.under shall be as City's
agent, and the City agrees to hold the County harmless from and defend
the County and the officers and employees thereof against any claims
or liabilities, including attorney's fees, resulting from performance of
the services provided her.under.
1985, and remain in force until terminated.
Either party may cancel this Agreement at any time by giving the other
party thirty (30) days written notice thereof.
If for any reason any provision hereof shall be inoperative, validity of
all other provisions shall not be affected hereby.
No modification or waiver of any provision of this Agreement shall be
valid unless in writing signed by both parties.
IN WITNESS WHEREOF, the parties hereunto set their hands and seals on this
year and date first above written.
