MUTUAL GENERAL RELEASE
KNOW ALL MEN BY TIIESE PRESENTS:
That the undersigned Seminole County, Florida, and the City of Sanford, Florida, for good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do,
hereby, and on behalf of all their respective successors and assigns, fully release, waive, and
forever dis~harge one another, and their agents, servants, employees, sureties, heirs, personal
representatives, assigns and successors, and all other persons, firms or corporations connected
therewith, of and from any and all claims, demands, causes of action, damages, judgments or suits
at law and equity of whatsoever kind, whether due or not, direct or contingent, liquidated or
unliquidated, patent or latent, known or unknown, involVing the claims of Cone Constructors,
Inc., or that certain action entitled Cone Constructors. Inc. vs. Seminole County. Florida. Case
Number 98-11491-CA-15, in the Circuit Court for Seminole County, Florida, for the project
known as the Sanford Avenue Road Improvements Project (the "Project") located in Seminole
County, Florida.
The undersigned acknowledge full and complete satisfaction, represent and warrant that
they have not assigned any right, claim, or cause of action against the releasor and declare and
represent that no promises, inducements, or agreements not herein expressed. have been made. It
is further acknowledged that this Mutual Release contains the entire agreement between the
parties hereto concerning the above-referenced claims, arid that the terms of this Mutual Release
are contractual and not mere recitals. Lastly, the undersigned warrant that they are duly
authorized and competent to execute this Mutual Release. ~
