871-Cameron City Grove CAMERON CITY GROVE PROPERTY-UTILITY AGREEMENT
This Agreement is made and entered into this ~54'h day of ,3t:xn,.o.r.j ,2001, by and
between William E. Kirchhoff, Jr., Trustee and Nixie Coleman, Trustee of the William E.
Kirchhoff, Jr., Revocable Trust, and Sadique Jaffer of Airport Industrial Partners, LLC,
collectively referred to as Owners ("owners") whose mailing address is 2044 Hibiscus Court,
Sanford, F132771 and 725 Magnolia Avenue, Orlando, F132801, respectively and the City of
Sanford, a municipal corporation organized and existing under the laws of the State of Florida
("City"), whose address is Post Office Box 1788, Sanford, Florida, 32772-1788.
WHEREAS, the City will be extending a potable water line and a sanitary sewer force main to
new Water Reelmaation Facility.
WHEREAS, the City will be constructing a potable water line and a sanitary sewer force-main in
the future fight-of-way of the extended East Lake Mary Blvd., which will connect to SR46,
WHEREAS, the owners will be annexing the Cameron City Grove property into the City for
future development.
WHEREAS, both the owners and the City wish to cooperate on the location if future potable
water and sanitary sewer line connections,
NOW, THEREFORE, in consideration of the premises, mutual covenants, agreements and
promises contained herein, the parties do hereby covenant and agree as follows:
1. The City will have designed a potable water line stub-out and a sanitary sewer
force-main stub-out to the Cameron City Grove property in conjunction with our
utility extension projects. The general location of these stub-outs are shown on
the attached drawing.
2. Future construction of the potable water and sanitary sewer force-main by the City
will occur after Seminole County has acquired all needed road fight-of-way for the
East Lake Mary Blvd. extension to SR46 and has designed and constructed this
road. The City may elect to construct our utility lines during the road construction
process.
