684-FL Public Utilities Co HURRICANE DISASTER AGREEMENT
THIS AGREEMENT entered in this ~2/-~ day of ~-A~,/~ ,1998, by
and between FLORIDA PUBLIC UTILITIES COMPANY/FLO-GAS CORPORATION (hereinafter
referred to as the "Gas Company"), and the City of Sanford, (hereinaf~er referred to as the "City").
WHEREAS, the parties wish to establish procedures to be followed in the event of a hurricane
disaster to provide more adequate and timely emergency service to the public,
It is agreed as follows:
1. This Agreement shall be effective whenever a hurricane warning has been issued for
Seminole County.
2. For the duration of the hurricane warning, the City will provide housing for
approximately six (6) Gas Company personnel at its facility located at 1303 S. French Avenue,
Sanford, Florida 32771.
3. Gas Company personnel will arrive no earlier than six (6) hours prior to a hurricane
landfall and will be provided housing until adequate aftermath restoration allows their return to Gas
Company facilities. The Gas Company will provide food, clothing and necessary supplies to their
personnel, and will assign a supervisor who will be responsible for the direction and supervision of
Gas Company personnel.
4. The City agrees to provide outdoor parking for five (5) vehicles to Gas Company.
5. Gas Company agrees to fully protect, defend, indemnify and hold harmless the City
and its officers, directors and employees, from and against all claims, demands and causes of action
of every kind and character on account of bodily injury, death or damage to property in any way
arising out of or associated with the activities of Gas Company personnel acting under and pursuant
to the Agreement, including indemnification for all attomeys fees, cost and expenses associated with
any claims, demands or actions.
6. This Agreement shall remain in effect until terminated in writing by either party
delivered to the other by certified mail.

SUBJECT: Florida Public Utilities Company Agreement
Enclosed are agreements with Florida Public Utilities Company to be
executed by the City, I think this is an excellent idea and have
also contacted Florida Power & Light to see if they are interested
in entering into some similar agreement. This would give us two
(2) utility companies on sight able to respond in a rapid manner.
