Box 1788 Sanford, Florida 32772-1788 J b:~' /:)JACL Dear Mr, Simmons: The purpose of this letter is to seek City approval of end to provide en. estoppel letter relating to a model home center that we would like to construct as part of our proposed Country Club Perk Subdivision (the "sub- division"), We would like to request that the City authorize the construc- tion end issuance of a Limited Cer~,ificate of Occupancy for model hcmes to be the model center relating to the Subdivision, The conditions of the approval would be as follows and we recognize that this approval will be made with numerous limitations as set forth herein, We recognize that this approval will not exempt us from c~mplying with eny provismons of the City' s Land Development Code or eny other applicable regulations end that we will not be guarenteed approval of eny other development orders or development permits relating to the Subdivision, our request relates to Building Permit ~qes./~ -F/0~ Jp/~-F for single family residential units. No Certficiate of Occupancy will be issued by the City for the homes until all required-SabdiVision improvements have been installed, inspected end authorized for use end acceptance into the City-owned road and utility system. We recognize that if all matters relatin9 to the Subdivision ere not approved end if the Subdivision does not proceed to obtain final approval in accordance with the City's lend development regulations that the nxadel homes may be of no economic utility or use for us inscrouch as they would be Eketable. We recognize that the City' s lend development regulations require us to post certain mainten- ence bonds and assurences relatin9 to i~rovaments that will be a part of the Subdivision including, but not limited to, roads, drainsge~ water, sewer and other facilities. City of Sanford Page Two We hereby grant the City the right to deny use of these structures for occu- pancy or habitation, other than as model hcmes displayed for sales purposes. As to this specific matter and all other matters set"forth herein, we agree to indemnify and hold the City blameless and harmless for any and all losses, damages, in]uries and claims in anyway relating to the construction of the model homes and the Subdivision. We assume any and all risk relating to the model homes and the Subdivision. We also agree to provide temporary toilet facilities elsewhere in the Subdivision which would serve model center patrons. all of our successors ~n interest.
