467-Wall AGREEMENT
THIS AGREEMENT, Made and entered into thiscilia day of
,lULl[ , A.D. 1956, by and between ROY WALL and RUTH
WALL, his wife, hereinafter called parties of the first part, and the CITY
OF SANFORD, FLORIDA, a municipal corporation, hereinafter called
Party of the Second Part,
WITNESSETH, WHEREAS, Parties of the first part are the
owners of certain real estate in the City of Sanford, Florida and are in
the process of platting and subdividing the same to be known as Wall Sub-
division, which said plat has provided therein certain easements for public
Utilities, and
WHEREAS, Party of the second part has been requested to vacate
certain public utilities easements located on said property as is now shown
by the plat of Block 1, Second Section of Dreamwold, according to Plat Book
4, page 30, Seminole County Public Records, on which said easement there
is existing at the present time city sewage lines, and
WHEREAS, The parties hereto have reached an agreement con-
cerning the abandonment of said existing easement,
NOW, THEREFORE, For and in consideration of the sum of Ten
Dollars together with other valuable consideration, the parties hereto agree
as follows:
1. Party of the second part agrees to accept the plat of Wall
Subdivision, and accept the new public utilities easement as platted thereon,
vacating the existing easement as is presently shown in th~ aforesai~ plat
of Block 1, Second Section of Dreamwold.
2. Party of the first part agrees that at such time as it may
become necessary for the City of Sanford to construct new sewer lines on
the newly dedicated easement of Wall Subdivision that parties of the first
part, upon thirty-days notice by the City to said parties, pay the City of
Sanford the cost of purchasing and laying 189 feet of 8-inch vitrified clay
sewer pipe, together with three manholes in connection therewith. Parties
of the first part further agree that in the event the said payment is not made
within thirty (30) days after the aforesaid notice is given by party of the
second part, that party of the second part shall then have the right to claim
a lien, and by this instrument have in fact have a lien against the property
in Wall Subdivision, adjacent to said easement.
THIS INSTRUMENT Shall be binding upon the heirs, successors,
grantees, administrators, and assigns of the parties hereto.
Parties of the first part covenant that they have full right and
this instrument and warrant the title in the aforesaid
~to~party of the second part.

therein expressed.
