AGREEMENT FOR USE OF 'BUILDING AND/OR GROUNDS

the party of the first part, and CITY OF SANFORD hereinafter
referred to as the City.
WITNESSETH:
WHEREAS, the City desires to use the facilities of the party
of the first part known as The Salvation Army located at 700 W.
24th STREET, SANFORD, FL for the sole benefit and enjoyment of
the citizens and residents of the area.
AND WHEREAS, the party of the first part desires and wishes to
make available to the city, its citizens, and residents the above
mentioned premises,
NOW THEREFORE, in consideration of the covenants and
agreements herein contained, it is mutually agreed that the above-
mentioned premises shall be used and maintained by the City,
subject to the following terms and conditions:
1. The undersigned will use the premises for the purpose of
CITY OF SANFORD RECREATION PROGRAMS and no other
purpose.
2. The City will use the premises for the above purpose
during the times specified on attachment "A", attached
hereto and incorporated herein by reference.
3. The City agrees that While'the premises are used by it,
that it will be responsible for any damage to the
premises, its furniture, fixtures or other accoutrements
arising out of the City's use. The City further agrees
that ~t will not permit any person associated with its
use of the premises to operate a motor vehicle on the
grounds, other than in t~e area specified for normal
parking. The city further agrees that it will pay for
damage arising out of its use of the premises.
4. In recognition of the fact that The Salvation Army is a
nonprofit organization making the premises available for
the benefit of the City, the City agrees to the extent
provided by law to save harmless The Salvation Army, its
trustees, officers and members, from any liability for
injury to persons or property arising during the use of
the premises by the City, or as a result of such use, and
further agrees to defend any suit brought against The
Salvation Army, its trustees, officers and/or members, as
a result of the use of the premises by the City.
5. In the event that, prior to one month before the
commencement of the above rental period, the party of the
first part shall determine that its own organizational
needs require use of the above premises for all or part
of the above-mentioned rental period, the party of the
first part shall have a right to cancel this agreement
without being liable to the City for any damages that it
might sustain on account of such cancellation.
6. The City of sanford agrees to reimburse the Salvation
Army the following for the use of its facilities:
A. For February 1, 1992 through September 30, 1992
$650.33 Monthly X 8 Months = $5,202.64 Total
7. Either party may cancel this agreement upon one hundred
eighty (180) days written notice one to the other.
NOTE: Long distance telephone calls shall not be made on The
salvation Army telephones and the City shall assume
responsibility for same during the hours of oRe~a~ion by
the City.
IN WITNESS WHEREOF, the parties hereto having executed-this
agreement, the day and year first above written.

ATTACHMENT A
1. The scheduling of events on the premises shall be done by the
City of Sanford based on the following priorities:
A. During the school year Monday through Friday, 2:30 P.M.
until 10:00 P.M., except as noted below.
During the summer 8:30 A.M. until 10:00 P.M.
B. Facilities will be closed Saturday and Sunday and at 6:00
P.M. on Tuesdays.
2. Premises to be used exclusively by the city of sanford as
specified above includes: the gymnasium, gameroom, play-
ground, one (1) office. In addition, The City of Sanford
will have joint use of restrooms and kitchen during these
times.
