Item 19 REQUEST: Issuance of a 30-year sovereignty, submerged land use agreement containing 10,900 square feet, more or less, for a public discharge outfall line. COUNTY: Seminole Application No. 591886624 Easement No. 21772 Use Agreement No. UA-59-080 APPLICANT: City of Sanford LOCATION: Sections 16, 22, and 23, Township 19 South, Range 30 East, in the St. Johns River, Class III waters, Wekiva River Aquatic Preserve, Resource Protection Area 1, within the local jurisdiction of Seminole County. CONSIDERATION: N/A STAFF REMARKS: The applicant is proposing to install a discharge outfall line into the St. Johns River east of SR 17-92 bridge, to be located within the Department of Transportation right-of-way easement no. 21772 approved by the Board of Trustees in 1958. The discharge line will begin at the treatment plato in Sanford and is designed to discharge a flow of one million gallons per day on an average armual basis, which complies with the water quality based effluent limitation requirements from the Department of Environmental Regulation (DER). Treated wastewater is being used to irrigate uplands in this area. When extreme wet weather occurs, the treated wastewater flows into the lake. DER wants to stop any excess treated wastewater from entering Lake Monroe because of the current water quality in the lake. The applicant presented different alternatives to DER in order to correct this situation. The only acceptable alternative is to install the outfall line into the St. Johns River at a point of high velocity. The installation of the outfall line will require the dredging of 440 cubic yards of material which will be utilized to backfill the installed pipeline. As such, the project should only be approved if determined by the Board of Trustees to be in the public interest consistent with section 258.42, F.S., and section 18-20.004(2), F.A.C. Staff is of the opinion that the project is in the public interest in light of the following: (1) the applicant has agreed to compensate for use of the area by removing exotic vegetation Cattail CI'ypha .l. ati.fol.ia and Colocasia esculenta) within a 12,500 squar~ foot area adjacent to the project site and revegetating the area with Giant Bulrush (Scirpus Califomicus), Arrowhead (Sagittaria lancifolia), and Knotgrass (paspalidium geminatum). A revegetation plan has been addressed as a special approval condition; and (2) the outfall line will eliminate all effluent discharging into Lake Monroe as mandated by the DER. To comply with the removal of the aquatic vegetation at the site and the revegetation plan, the applicant will obtain an Aquatic Plant Control Permit from the Department's Bureau of Aquatic Plant Management. This has been addressed as a special approval condition. ' A local government comprehensive plan has been adopted for this area pursuant to section 163.3167, ~: F.S. The Department of Community Affairs has determined that the plan is in compliance. The grantee shall comply with the standard construction conditions recommended by the Division of Marine Resources for the protection of the endangered manatee. The contractor instructs all personnel associated with the project of the potential presence of manatees and the need to avoid collisions with manatees. 2. All construction personnelare advised that~there are civil and criminal penalties for harming, harassing, or killing manatees which are protected under the Marine Mammal Protection Act of 1972, the Endangered Species Act 0f 1973, and the Florida Manatee Sanctuary Act. The permittee and/or contractor may be held responsible for any manatee harmed, harassed, or killed as a result of construction activitieS, 3. SiltatiOn barriers are made of material in which manatees .cannot. become' entangled, are properly secured, and are regularly monitored to avoid manatee entrapment. Barriers must not block manatee entry to or exit from essential habitat. 4. All vessels associated with .the project operate' at "no wake/idle" speeds at all times while in water where the draft of the vessel provides less than a four foot clearance from the bottom and that vessels will follow routes of deep water whenever possible. 5. All construction activities in open water cease upon the sighting o~ a manatee(s) within 100 yards of the project area. Construction activities will not resume Until the manatee(s) has departed the project area. 6. Any collision with and/or injury. to a manatee is reported immediately to the Florida Marine Patrol (1-800-DIAL FMP) and to the U.S. Fish and Wildlife Service, Jacksonville Office (904-791-2580) for North Florida and to the Vero Beach Field Office (407-562-3909) for South Florida. Prior to commencement of construction each vessel involved in the construction shall display in a prominent location, visible to the operator an 8 1/2" x 11" temporary placard reading, "Manatee Habitat/idle Speed in Construction Area". In the absence of a vessel the placard will be located prominently adjacent to the issued construction permit. A second temporary 8 1/2" x 11" placard reading, " Warning Mariatee Area" will be posted in a location prominently visible to water related construction crews. A temporary construction notice criteria sheet (temporary notices are constructed by permittee) is attached. Temporary notices will be nemoved by the permittee upon completion of construction. 8. The contractor maintains a log detailing sightings, collisions, or injuries to manatees should they occur during the contract period. Following project completion, a report summarizing incidents and sightings is submitted to the Florida Department of Natural Resources, Marine Research Institute, Office of Protected SpeCies Research, 100 Eighth Avenue, Southeast, St. Petersburg, Florida 33701-5095 and to "%he U.S. Fish andWildlife Service Office, 3100 University Boulevard, Jacksonville, Florida 32216. MarinaS, Docking/Launching Facilities Permanent Caution and InformationDispla~ Signs 9. Permanent manatee awareness signs are installed and maintained (facing land) at docking and launching facilities. Prior to the dockin~ and launchin~ facility be~innin~ operations, the permittee will send a project.site plan to the Department of Natural Resources, DiVision of Marine Resources Office, Protected Species Management, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399. FDNR will then specify on the site plan permanent locations for '!Caution Manatee Area" and "information Display" signs. 10. The permanent signs ~ill read "Caution Manatee Area" and shall be 4'x 3', 125 gauge61TS aluminum~ covered with white, engineer grade, reflective sheeting; black, screened lettering and design; and orange, engineer grade, reflective circle and border. These signs shall conform to the Florida Uniform Waterway Marking System in accordance with F.S. 327.40-1. The installation of these signs shall be made in accordance with the FDNR specifications for such signs. Sign installation specifications and a permanent manatee awareness sign criteria sheet (depending on issuing agency) may be attached or will be forwarded when sign plan has been reviewed and permanent sign locations are designated by FDNR. A permanent "Information Display" (consisting of two signs "Manatee Basics for Boaters" and "West Indian Manatee Fact Sheet") is installed prior to mogring occupancy at a prominent location (facing land) to increase the awareness of boaters using the facility of the presence of manatees and of the need to minimize the threat of boats to these animals. The number of "Information Displays" (sets) required will depend on the docking/launching facility design. Permanent "Information Display" locations will be specified by FDNR personnel when permanent sign location sites are designated (#9 above). A list of suppliers of the "Informational Displays'! will be forwarded with permanent site plans. The "Ihformation Display" signs remain the responsibility of the owner(s) and are to be maintained for the life of the docking/launching facility in a manner.acceptable to FDNR. 12.' Verification that permanent signs have been installed at designated locations shall'be provided to FDNR, Protected Species Management (address #9. above), before the marina ~ocking/launching.facility begins operations.
