435-Veterans Administration MedMEMORANDUM TO: City Manager/2~Y FROM: Director of Engineering and Planning SUBJECT: Veterans Administration Medical Center, Memorandum of Understanding DATE: January 5, 1~89 Mr. Faison: Veterans Administration letter of December 21, 1988 requests a written offer by City of Sanford to donate 50 to 75 acres to the Veterans Administration as a medical center ~ite. This offer must remaih available through September 1990. The attached Memorandum of Understanding, similar to the one developed for the Federal Prison System, has been prepared for approval by the City Commission and execution by the Mayor. It is requested that this item be placed on the City Commission agenda for January 9, 1989. WAS:mca MEMORANDUM OF UNDERSTANDING REGARDING VETERANS ADMINISTRATION MEDICAL CENTER WHEREAS, the City of Sanford, [lorida received a letter dated December 21, 1988, from the pnited States Veterans Adminis- tration concerning their interest in locating a Veterans Adminis- tration Medical Center in the Sanford area, and WHEREAS, the facility is described as.a Medical Center requiring a minimum of 50 to 7~ acres whfch must be available through September 1990 to be donated to the Veterans Administra- tion; and WHEREAS, the Veterans Administration has requested a writ- ten expression from the City of Sanford of its support for the facility, and WHEREAS, the City has reviewed the request and at a regu- lar City Commission meeting held on January 9, 1989, authorized the preparation of an appropriate memorandum of understanding express- ing the City's support and willingness to cooperate with the Veterans Administration including donation of the parcel identified on Attachment A, or a mutually agreeable alternative parcel within the City property shown on Attachment ~. It is, therefore, the City's intent by this ~morandum to express its support for the project and its understanding concern- ing the rights and responsibilities of the City and the Veterans Administration as follows: 1) The items recited above are true and correct and are incorporated herein. 2) The City of Sanford will donate the Medical Center site land as described in Exhibit "A" in consideration of agreements that the Medical Center facility will obtain water and sewer service from the City Of Sanford and will agree to take back and reuse public access quality reclaimed water for irrigation. 3) The Veterans Administration will be responsible for the design, permitting, and construction of necessary pipelines ser~e the. prison site, connecting toexisting_or pl~n~ed_Ci~y uti lity lines within City of Sanford, for potable water, wastewater, and reclaimed water, only if these lines have not already been built or committed for construction by the Federal Bureau of Prisons. 4) Following construction of the utility lines, they will be donated to City of Sanford for ~wnership ~nd operation. 5) This memorandum is not intended to be a contract, but is an expression of positive interest and intent on the part of the City of Sanford. If continued discussion produces an agreement to proceed with the project by the Veterans Administration and the City of Sanford, it is contemplated that the items contained in this memorandum together with other terms and conditions yet to be discussed and agreed to by the parties will be incorporated into a formal contract.
