398-Traffic Enforcement TRAFFIC ENFORCEMENT AND MANAGEMENT TEAM INTERLOCAL AGREEMENT SEMINOLE COUNTY/CITY OF SANFORD THIS AGREEMENT entered into this /~/~ day of ~/-j' 1990, by and between SEMINOLE COUNTY, a political subdivision of the State of Florida (hereinafter referred to as the "COUNTY") whose address is 1101 East First Street, Sanford, Florida 32771 and the CITY OF SANFORD, a Florida municipal corporation (hereinafter referred to as the "CITY") whose address is Post Office Box 1778, Sanford, Florida 32772-1778. WITNESSETH: WHEREAS, Florida law provides for and authorizes Interlocal .Agreements between cities and counties for the performance of their respective administrative and service functions; and WHEREAS, the CITY and the COUNTY desire, pursuant to Chapter 163 of the Florida Statutes, to enter into this Agreement to create a Traffic Enforcement and Management Team; and WHEREAS, the individuals who would be part of the Traffic Enforcement and Management Team currently are actively participat- ing in the Freeway Management Team created by the State of Florida Department of TranspBrtation; and, WHEREAS, the services potentially required to be performed by the Traffic Enforcement and Management Team during catastrophic events or emergency situations involving traffic enforcement and management on and upon the roads, streets and ways in Seminole County and the cities within Seminole County are not limited to the Freeway and are expanded to include all roadways within Seminole County; and WHEREAS, it would be in the best interests of the citizens of Seminole County and the municipalities located within Seminole County for the COUNTY, the CITY and all other cities within Seminole County to cooperate in the creation and maintenance of a Traffic Enforcement and Management Team. MOW THEREFORE, in consideration of the mutual covenants herein contained, it is agreed as follows: SECTION 1. RECITALS. The above recitals are true and correct and form a material part of this Agreement upon which the parties have relied. SECTION 2. PARTICIPATION IN TRAFFIC ENFORCEMENT AND MANAGEMENT TEAM. (a) The COUNTY and the CITY agree to allow appropriate employees to cooperatively participate in a Traffic Enforcement and Management Team which will consist of appropriate designated employees of the COUNTY, the CITY and other cities located within Seminole County. (b) The parties agree, to the maximum extent permitted by law, to hold the other harmless ~rom and against any claims or liabilities resulting from performance of the services provided hereunder. SECTION 3. GUIDELINES. The Traffic Enforcement and Management Team shall follow the following guidelines: (a) A minimum notice of two (2) hours prior to mobilization is encouraged. Notice shall be given by the party requesting assistance from the other. (b) The party requesting assistance shall be responsible for coordination of necessary Team Members and shall provide the following information to these individuals: (1) Location of the emergency; (2) Type and characteristics of the emergency; (3) The agency or individual requesting the call out of Team Members; and (4) The Command Post; officer in charge; agency in control; and contact method (radio number, telephone number). (c) Twenty-four (24) hour contact names, phone numbers (to include Command Post) and radio numbers shall be made available to all Team Members and shall be kept current. (d) The party requesting assistance shall be in charge of all directions given and tactics utilized during the course of a Team operation. (e) The traffic engineers for the COUNTY, the CITY and the other cities locate~ within Seminole County may enter into a Memorandum of Understanding to further coordinate the activities of the Team. SECTION 4. TERM. This Agreement shall take effect on the date that it is fully executed by the parties and shall remain in effect until terminated by the parties; provided, however, that either party may cancel this Agreement at any time by giving the other party at least thirty (30) days written notice thereof. SECTION 5. SEVERABILITY. If for any reason any provision hereof shall be inoperative, validity of all other provisions shall not be affected thereby. SECTION 6. AMENDMENTS. No modification, amendment or waiver of any provision of this Agreement shall be valid unless reduced to writing signed by both parties.
