Lauderdale, Florida 33334 (hereafter referred to as the "GRANTOR ") and the CITY OF SANFORD, a Florida municipal corporation, whose address is 300 \ \ l9 North Park, Sanford, Florida 32771 (hereafter referred to as "CITY "). WITNESSETH: FOR AND IN CONSIDERATION of ONE AND NO /100 DOLLAR ($1.00) and other good and valuable consideration, receipt of which is hereby acknowledged, GRANTOR, does hereby give, grant, bargain and release to the CITY, a temporary easement to enter upon the following lands of the GRANTOR, said real property being described as follows: TAX PARCEL IDENTIFICATION NUMBER: 25 - 19 - 30 - 5AG - 0303 - 0040 FOR THE PURPOSES of allowing the CITY to construct banner signs from time- to-time by attaching the supports relating to the banner signs to the building located on said GRANTOR's property in a non - building degrading manner and to access the said real property and to conduct any and all reasonable acts and works as aforesaid in order to install, maintain and remove the banner signs. 1'Page THIS EASEMENT shall commence upon the date of execution and expire upon notice to the CITY by the GRANTOR as evidenced by an affidavit executed by either the CITY's City Engineer or the CITY's Public Works Director said affidavit being delivered to the GRANTOR. BY ACCEPTANCE AND USE of the easement rights granted herein the CITY agrees to accept, to the extent permitted by law and subject to the limits set forth in law, responsibility for its acts of negligence and, further, agrees to reasonably return the subject property to the condition that it existed in prior to the use of the said property by the CITY. Notwithstanding the foregoing, the CITY does not hereby waive or release any rights inuring to its benefit under the provisions of Section 768.28, Florida Statutes, and other applicable law.
