294-Sanford Auto Auction DEVELOPMENT AGREEMENT
THIS AGREEMENT is made and entered into this C~7~L~ ,

of ~'~na~te , 1987 by and between the City of Sanford
(herei r called "City") and Sanford Auto Auction, a
corporation under the laws of the State of Florida (hereinafter
called "Developer");
WITNESSETH
WHEREAS, the Developer and the City wish to enter into an
agreement to jointly fund the installation of an eight-inch
(8"), or larger, potable water line running in the south side of
the right-of-way of State Route 46, East, connected to the City
water line now existing near the intersection of State Route 46
and Brisson Avenue, and extending eastward along the State Route
46 right-of-way to the west-side of Cameron Avenue; and
NOW, therefore in consideration of the mutual promises and
covenants herein contained, the parties do agree as follows:
1. The foregoing recitals are true and correct.
2. The Developer and City agreed to jointly fund the cost
of installation of the said potable water line to be constructed
in the right-of-way of State Route 46 (East), connecting to the
City water main now existing in the vicinity of Brisson Avenue
and State Route 46. The City shall provide plans for this
installation and shall obtain necessary permits. The Developer
shall pay all material costs, predicated on installation of an
eight-inch (8") PVC line, in accordance with City material speci-
fications. The City reserves the right to increase the size of
this line and will pay the additional material and labor costs
above the cost fDr the eight-inch (8") line, if it so elects.
The City will provide all labor, equipment, and over- head for
the installation, completion and testing of this line. A copy
of the cost estimate for this work is attached as Appendix A.
The City will expedite completion of the water line installa
tion, with estimated completion date to be 180 days following
execution of this Development Agreement.
3. The Developer's share of costs of the water line
installation will be billed as soon as contracts for purchase
have been awarded. Developer shall make payment within fifteen
days of billing. A connection to the potable water line will not
be allowed until all bills rendered under this Agreement have been
paid in full.
4. This Development Agreement is subject to the condition
that Florida Department of Transportation (FDOT) issues a right-
of-way use permit which permits utilization of FDOT right-of-way
for installation and maintenance of the water line. The City
shall be responsible for maintenance of same once it has been
constructed and accepted by the City. In the event the right-of-
way use permit is not obtained from FDOT within sixty (60) days
of the date of this agreement then either party to this
Development Agreement may cancel said Agreement by giving written
notice to the other party. Said written notice shall be conclu-
sively deemed a cancellation and shall relieve each party from
further obligations under this development agreement.
5. It is understood and agreed that developer will be
responsible for the payment of water impact fees, tap fees if
applicable, and water consumption rates specified in the City
rate ordinance for outside City customers.
6. Developer will execute an irrevocable annexation
petition and that shall be automatically executed when/if the
subject property meets the conditions of the Florida Statute
related to voluntary annexation.
7. Parties do hereby agree that this Agreement constitutes
the full and final agreement between said parties as of the date
hereof and no modifications or amendments thereto shall be
binding on either party unless executed with the same formalities
hereof.
IN WITNESS WHEREOF the parties have hereunto set their hands
and seal the day and year first above written.
