205-CPH-Amendment 21 AMENDMENT 21 SITE lO SITE SPECIFIC, PRELIMINARY ENGINEERING, AND MODIFICATION OF 201 PLAN TO AGREEMENT DATED DECEMBER 7, 1983 FOR CONSULTING ENGINEERING SERVICES FOR WASTEWATER TREATMENT AND EFFLUENT DISPOSAL FACILITIES BETWEEN THE CITY OF SANFORD, FLORIDA AND CONKLIN, PORTER AND HOLMES-ENGINEERS in the year Nineteen Hundred ~gh S en tHE CITY OF SANFORD, FLORIDA (hereinafter called the CITY) and CONKLIN, PORTER AND HOLMES-ENGINEERS, INC. (hereinafter called the ENGINEER), is mutually agreed upon and declared an authorized Amendment to an Agreement dated December 7, 1983, between the parties, herein setting forth the scope, terms and conditions of the work herein authorized. A. GENERAL Subsequent to the approval of the Amendment to the 201 Plan by the City Commission on July 28, 1986, and the State of Florida, Department of Environmental Regulation, Bureau of Wastewater Management and Grants on February 12, 1987, final engineering plans and construction documents have been completed and submitted to FDER for construction of all parts of the immediate program consisting of Treatment, Water Reuse Distribution System, Treated Water Storage in Tanks, and Irrigation Systems at the Airport, Golf Course and City Parks. Additionally, the City has purchased Site lO (approximately 1875 acres) as a back-up/supplementary water reuse site. Because of the need to investigate Site lO further and ready it for back-up or supplementary use, this Amendment is being authorized to initiate the work generally described below and more fully shown on the attached Plan of Study which is a part of this Agreement. Some of the following services will be provided by CONKLIN PORTER AND HOLMES personnel and others through qualified subcontractors employed by CONKLIN PORTER AND HOLMES and approved by the CITY.. As shown in the Plan of Study, it is anticipated that subcontract services will include: (1) soils consultant, (2) archaeological, biological and cultural resources survey and assessment, (3) geohydrologic consultant, (4) environmental laboratory, (5) environmental jurisdiction and permitting consultant and (6) agricultural consultant. B. SERVICES HEREIN TO BE PROVIDED 1. SITE SPECIFIC STUDIES All studies are for the purpose of performing landspreading and agricultural use of the site. The work includes preparation of scope of surveying services and assistance in defining, directing, coordinating and reviewing aerial photography and topographic mapping of the site, which surveying is to be performed under separate contract with the Owner; supplementary soils and geohydrologic studies; surface and groundwater quality studies; water and nutrient balances; archaeological, biological assessment studies of site plants and animals; inventory and analysis of adjacent water wells; environmental permitting jurisdiction requirements of the St. Johns River Water Management District (SJRWMD), Florida Department of Environmental Regulation (FDER), Corps of Engineers (C.O.E.) and Seminole County and other appropriate agencies; conceptual environmental mitigation plan; ground water monitoring plan; and baseline studies of existing conditions to document existing conditions on and directly adjacent to the site so future conditions after implementation of the plan can be more rationally compared. 2. PRELIMINARY ENGINEERING This work is to include preliminary engineering of site improvements to implement land application of reclaimed wastewater on the site for agricultural or disposal purposes. Alternative, phased systems will be preliminarily designed and compared. The selected recommended phased system preliminary engineering will be refined beyond the other alternatives considered and opinions of probable cost to construct and operate the recommended system will be included as well as estimates of return from cropping or leasing. In addition, studies and recommendations will be included on alternative crop or crops and whether a direct CITY operation or lease operation is in the CITY's best interest. Also included in the Preliminary Engineering studies are transmission and storage studies from the previously designed water reuse transmission system at the Airport on eastward to Site lO. Included in the storage studies will be volume and method of storing treated effluent with appropriate studies to justify the volume of storage proposed. Also included are preliminary surface water management studies of the tract with recommendations. 3. MODIFICATION OF THE APPROVED 201 PLAN Modification of the approved 201 Plan including documentation of the recommended approved studies into a 201 Plan Amendment for submission to the State Clearinghouse, FDER and other agencies. An initial stage of the work will include a more detailed evaluation of the possibility of accelerating and enlarging the irrigation of residential, commercial, school and other private property including preliminary work on the capacity that could be gained as well as the distribution lines required and the costs and feasibility of accelerating and enlarging this portion of the currently approved 201 Plan. Also included is assistance with a required public participation work plan and presentation of the Amended 201 Plan at a Public Hearing. Also included will be efforts by the ENGINEER to assist the CITY in their endeavor to obtain restructuring of existing State and Federal Grants and to obtain additional grants to cover Site 10 development. 4. APPLICATION TO SEMINOLE COUNTY Assistance with applications and presentations to County Staff and Boards for Conditional Use or Special Exception or the appropriate rezoning of the tract as may be determined as required by the CITY for the proposed use of the site is included under this work item. C. AUTHORIZATION OF SERVICES AND PAYMENTS TO THE ENGINEER It is the intent of this Agreement that upon execution of the same, all services described herein are authorized to be performed. For the performance of the Scope of Work described herein, payment to the ENGINEER by the OWNER shall be on the basis of cost times a multiplier, in accordance with Section 5 titled METHOD OF PAYMENT TO THE ENGINEER of the Agreement dated December 7, 1983, except that the current fringe benefit factor is 1.4376. The payroll cost multiplier shall be 2.10. The estimated not-to-exceed fee for the work herein authorized is $180,998.25, including those subcontractor services listed in the attached Plans of Study. Any additional subcontractor or specialist services which may be required will be billed to the OWNER additionally.
