Re: Utility Line Relocations - Lake Mary Boulevard
Bill -
As you are aware, Seminole County will be improving Lake Mary
Boulevard from Country Club Road to Highway 17-92. Seminole
County is proposing to bid this project in early fall of 1993.
The City has numerous water and sewer lines within the right-of-
way of Lake Mary Boulevard that will need to be relocated. I
have asked CP&H for a proposal to provide engineering services to
accomplish the relocation work.
Attached are two copies of the proposal from CP&H. Estimated
engineering fees are $34,127. Construction cost to perform the
actual relocation work may be in the $400,000 range.
It is recommended that the City enter into an agreement with CP&H
to perform this needed work. Funding for this project needs to
be determined.

Dear Mr. Moore:
We are pleased to submit this fee proposal for engineering services relative to utility relocafion
work for the Lake Mary Boulevard widening project.
Specific services to be provided by the Engineer include the following:
1. Meeting, coordination and reviewing the project with the City and the County to discuss
and/or obtain the available information on the overall scope and limits of the project.
2. Review the County provided roadway plans; check and review the potential conflict
locations; evaluate the options for the most feasible utility location; discuss with the
Owner and make recommendations.
3. Review and discuss with the County the proposed utility location within the roadway
project limits. Provide the County a preliminarily marked up roadway plan, showing the
location of the proposed utilities for the County's use to update their plans.
4. By utilizing information from the County 's plan, generate base drawings in 1" = 20'
scale for the Engineer's use in developing the construction plans for the utility relocation
work. Meet with the City and other utility companies to field verify existing utility
locations within a few target locations (City is to schedule and notify the Engineer for
field meetings).
5. Develop preliminary engineering plans by using the generated base. Meet and coordinate
with the City and the County. Utilize information regarding other utilities that may be
required to be relocated, and incorporate the City's and the County's comments and
information into the plans.

6. Review and analyze the existing forcemain and pumping capacities and determine the
sizing and location for a new forcemain to replace the City's two existing forcemains
within the project limits.
7. Develop a final engineering plan, which includes ti~e sheet, general notes, technical
specifications and testing requirements, plan and profile sheets (1"=20' scale) and
required construction details. Develop quantities and Opinion of Probable Construction
Cost. Provide the County with a copy of the final engineering plan to update the utility
locations on their roadway plans prior to sending the plans for bidding.
8. Coordinate with responsible regulatory agencies and assist the City in obtaining an FDER
and possibly a County construction permit for the work.
Please note that the base drawings will be generated by tracing and/or transferring the existing
information from the County' s roadway plans, and we wish to state that we have no knowledge
of the accuracy of the existing information shown. As is covered in our scope, a few target
locations need to be verified for existing utility locations. If the existing utility location is found
to be different from what is shown on the County's plan, we may require additional survey
information for proper development of our final engineering plans.
We will attempt to obtain a copy of the subsurface investigation report from the County. We
propose to review the County provided report and make a determination as to whether additional
soils investigations will be needed to specifically inform us of any special treatment that may be
necessary for proper pipeline construction. If additional soils work is needed, we propose to
coordinate with soils subconsultants for proposals for your review and authorization.
The above scope of services is per the intent of our Continuing Engineering Services Contract
with the City. We would be pleased to discuss the scope of services with you.
The Engineer's estimated fee, based on the manhours contained in the attached Plan of Study,
is $34,127.00.
If the above described services and estimated fee associated with those services are acceptable
to the City, please sign one copy of this letter proposal in the space provided and return it to us
for our records.

AND
CONKLIN, PORTER AND HOLMES-ENGINEERS, INC.
This Agreement made on the 9~'~Z' day of //l'l,41~C// , 1993 between the CITY
OF SANFORD, FLORIDA (hereinafter called the CITY) and CONKLIN, PORTER AND
HOLMES-ENGINEERS, INC. (hereinafter called the ENGINEER), is mutually agreed upon
and declared an authorized Amendment to an Agreement dated December 17, 1987,
between the parties, herein setting forth the scope, terms and conditions of the work
herein authorized.
In case of any conflict between this Amendment and the aforementioned Agreement
of December 17, 1987, this Amendment shall govern for the work described herein.
WHEREAS, the ENGINEER has previously prepared a Master Water Plan
(1986) and done a subsequent water system analysis for the CITY and under
Amendment 40 is amending, supplementing, and updating the Master Water Plan, and
WHEREAS, the existing Master Water Plan calls for extension of the CITY
water system westward toward Interstate 4, and
WHEREAS, the CITY is entering into Agreements with Seminole Towne
Center, other developments, and Seminole County to provide water service within this
westerly area and south of Sanford, and
WHEREAS, the CITY has requested the ENGINEER to perform Engineering
Designs, Construction Documents, and limited Construction Services for three (3)
watermain extensions and providing an auxiliary power source at the French Ave.
Booster Station.
NOW THEREFORE, the CITY and the ENGINEER for the considerations named
hereinaf~er agree as follows:
SECTION I
PRELIMINARY DESIGN PHASE
I. Preliminary Design Phase
In conjunction with revisions to the Master Water Plan underway under
Amendment No. 40, perform more detailed Preliminary Design phase services
in order to refine the scope and determine certain details needed to implement
Final Designs on the following work:
A. Study alternate routes, location, sizing and cost of a proposed water line
to extend from S.R, 46 north to the Old Lake Monroe Post Office. The
services of a sub-consultant surveyor will be utilized to determine ROW
along the routes and perform other general record search, Because
Upsala Road has a restrictive (narrow) right-of-way (ROW), deep ditches,
and congested ROW, consider other alternative routes either east or
west of Upsala Road to end up at the Old Post Office. Determine
governmental jurisdiction for all routes, permitting requirements, width
of ROW, occupation of existing ROW by ditches and other utilities; ROW
width and location remaining available for the water main and other
utilities; plans for widening the road and obtaining additional ROW;
possible need for separate utility easements adjacent to the road; and
other similar considerations. Consider flow requirements (including fire
flows) for near term and long term needs in order to refine line size
requirements and determine cost.
B, Obtain from the City and others the route for the relocation of Oregon
Avenue through the proposed Seminole Towne Center. In conjunction
with City staff and the developers, determine the portion of the proposed
watermain planned along the relocation of Oregon Avenue to be the
responsibility of the developer. Also, determine from City, flow and
pressure requirements for maximum day and fire at the Seminole Towne
Center and review capability of City system to meet these requirements.
The services of a sub-consultant surveyor will be utilized to determine
ROW along the City responsibility portions of the routes and perform
other general record search. From the north connection point to the
developers' portion of the line, examine routes, and position in ROW to
loop the line to S.R. 46 and East to connect to an existing City 16" main
at S.R. 46 and Central Parkway. From the south end of the developers'
line responsibility, examine the route location to loop the line to the end
of the existing 12" main on Oregon Ave. or alternately to S.R. 46A and
back to the water treatment plant and consider additional future route
locations for east/west loop reinforcing. The same ROW, route, flow
(including fire), sizing, costs, and other considerations as itemized in I-A
will be evaluated for the City portions of this watermain loop.
C. Consider R.O.W. and space available, flow and size of line to extend a
water main south on Sanford Avenue from north of the Railroad to Oak
Way. The services of a sub-consultant surveyor will be utilized to
determine ROW along the route and perform other general record search.
Give consideration to other improvements and relocations that may be
needed north of this location on Sanford Avenue in connection with a
current County Road project and other future water main Ioopings or
reinforcement routes that may be possible into the general area,
D. Perform preliminary investigations and Preliminary Design of emergency
generator and other related improvements at the French Avenue Booster
Station.
1. Utilizing an Electrical Sub-Consultant, perform an electrical
inspection, tests, and determination of the condition, capacity,
and ability of the existing electrical wiring and equipment at this
station to meet code requirements.
2. Perform preliminary design of the sizing, location, electrical
facilities, fuel storage, and other related matters for a proposed
emergency power generator set.
3. With the City administrative and operational personnel, examine
the existing booster station high service pumps, their capacity,
age, condition, reliability, maintenance needs, and availability of
parts in case of the need for repairs,
4. With the City staff, examine the general condition, need for
repairs, etc. of the French Avenue booster station building.
Detailed studies, such as architectural and/or historical
renovations or replacement are not included in the scope of this
initial authorization.
5. Perform preliminary opinions of cost for improvements chosen for
near future implementation by the City. ·
E. Prepare letter-type summary report or reports with maps and other
documentation needed (10 copies) showing the results of the Preliminary
Design studies and recommendations of work items I-A, I-B, I-C and I-D
above.
SECTION II
FINAL DESIGN AND
CONSTRUCTION PHASE SERVICES
II. Services of the ENGINEER
The ENGINEER agrees to perform Final Design and Construction Phase Services
in connection with the projects identified herein when the Preliminary Phase
work of Section I is complete. It is anticipated that the Preliminary Design
Phase Work is necessary/advisable to refine the scope and detail of the work
and that it will facilitate and reduce the amount of work necessary during the
Final Design process, The Final Design and Construction Phase services will be
authorized by the City when a refined scope of services and appropriate
engineering fee have been established,
SECTION III
ADDITIONAL SERVICES OF THE ENGINEER
III. Additional Services
If authorized by the CITY, the ENGINEER shall furnish or obtain from others the
following additional services, or the CITY may provide these services separately
or directly with the provider. Such additional services will be paid for by the
CITY as outlined in Section V.
A. Preparation of permit applications.
B. Additional services due to significant changes in the scope of the project
or its design including, but not limited to, changes in size, complexity,
character of construction or due to time delays in initiating or completion
of the work as described herein.
C. Provide, through sub-consultants, surveying, electrical, soils,
environmental scientist jurisdictional or permitting services, construction
quality control testing, or other sub-consultant services not previously
specified in Section I, if requested or authorized in writing by the CITY.
D. Except as otherwise provided herein, services or additional costs
associated with revising previously accepted studies, reports, or other
documents when such revisions are due to causes beyond the
ENGINEER's control.
E. Additional services resulting from public protests. administrative
hearings, or similar matters.
F. Preparing to serve and/or serving as an Expert Witness for the CITY in
any litigation, public hearing, condemnation proceeding, right-of-way or
easement acquisition or negotiation, or other legal/administrative
proceeding.
G. Furnishing additional sets of prints of the drawings and other documents
beyond those designated in Section I.
H. Additional engineering services required by revisions to regulations (after
the date of this Amendment) as applicable to the Florida Department of
Environmental Regulation, the St. Johns River Water Management
District, or other regulatory agency requirements.
h Additiona services in connection with the project including services
normally furnished by the CITY as described in Section IV herein and
services not otherwise provided for in this Agreement.
J. Investigations involving detailed consideration of operations,
maintenance and overhead expenses including preparation of operating
and maintenance manuals, feasibility studies, appraisals and valuations.
SECTION IV
THE CITY'S RESPONSIBILITIES
IV. The CITY will:
A. Advise the ENGINEER of his requirements for the project and designate
a person to act as the CITY's representative with respect to the work to
be performed under this Amendment, and such person shall have
complete authority to transmit instructions, receive information, interpret
and define the CITY's policies and decisions pertinent to the work
covered by this Amendment.
B. Provide data requested that is reasonably available on the existing utility
and street systems, along with operational and maintenance
requirements.
C. Guarantee access to and make all provisions for the ENGINEER to enter
upon public and private lands as required for the ENGINEER to perform
his work under this Amendment.
D. Provide personnel to locate facilities and mow, trim, or otherwise make
them accessible for inspection.
E. Examine all studies, reports, sketches, and other documents presented
by the ENGINEER and render decisions pertaining thereto within a
reasonable time so as not to delay the work of the ENGINEER.
F. Obtain approval of all governmental authorities having jurisdiction over
the project, and such approvals and consents from such other individuals
or bodies as may be necessary for completion of the Pro]ect.
G. Furnish or direct the ENGINEER in writing to provide at the CITY's
expense any sub-consultant services not designated in Section I, if
advised by the ENGINEER and CITY concurs that they are necessary.
H. Furnish, or direct the ENGINEER in writing to provide at the CITY's
expense, necessary additional services as stipulated in Section III of this
Amendment, or other services as required.
I. Provide such legal, accounting, and insurance counseling services as may
be required for the project, and such auditing services as the CITY may
require.
J. Give prompt written notice to the ENGINEER whenever the CITY
observes or otherwise becomes aware of any defect in the Project.
SECTION V
PAYMENT
V. Payment
A. Payment for services and expenses of the ENGINEER to be as set forth
below:
1. Principals and Employees of the ENGINEER.
a) Compensation paid ENGINEER for services described in
Section I, Preliminary Design Phase, and rendered by
principals and employees assigned to the Project will be
computed by multiplying Direct Personnel Expense (defined
herein) times a factor of 1.95 plus all reimbursable
expenses, plus outside sub-consultants, for a not to exceed
fee of 911,557.00.
b) Compensation paid the ENGINEER for the Services of
Section II, Final Design and Construction Phase Services,
have not yet been established pending later preparation of
a refined Scope of Services. The fee for Final Design Phase
work will be computed by multiplying Direct Personnel
Expense (defined herein) times a factor of 1.95, plus all
reimbursable expenses with a maximum to be negotiated
and stated in a subsequent letter of authorization.
2. Reimbursable expenses for items not specifically valued herein are
to be paid to the ENGINEER at the actual cost thereof. Said
expenses shall include transportation and subsistence of principals
and employees, when traveling in connection with the project, toll
telephone calls, telegrams and similar project-related items.
3. Services provided by outside sub-consultants will be billed at the
direct cost without increase.
B. ~The CITY will make prompt monthly payments in response to
ENGINEER's monthly statements without retention for all categories of
services rendered under this Agreement and for reimbursable expenses
incurred.
C. Direct Personnel Expense used as a basis for payment shall mean the
salaries and wages paid to principals and employees of all classifications
engaged directly on the Project, plus the cost of fringe benefits including
but not limited to, social security contributions, worker's compensation,
health and retirement benefits, bonuses, sick leave, vacation and holiday
pay applicable thereto. For purposes of this Amendment, Direct
Personnel Expense shall be considered an amount equal to 1.47 times
applicable salaries and wages.
D. Charges for the services rendered by principals and employees as
witnesses in any litigation, hearing or proceeding will be computed at a
rate of 9600.00 per day or any portion thereof (but compensation for
time spent in preparing to appear in any such litigation, hearing or
proceeding will be computed by multiplying Direct Personnel Expense
times a factor of 1.95 plus all reimbursable expenses.
E. If this Agreement is terminated during prosecution of the services prior
to completion of the services of Sections I and 11, payments to be made
in accordance with Section V, Paragraph A-1 -a). on account of that and
all prior work under this Amendment shall be due and payable, and shall
constitute total payment for services rendered. In addition, upon
termination, the ENGINEER shall be paid for any additional services
authorized and rendered under Section llh
SECTION VI
GENERAL CONDITIONS
I. General Conditions
A. Since the ENGINEER has no control over the cost of labor, materials, or
equipment or over any construction Contractor's method of determining
prices, any opinion of probable construction cost which may be provided
in the services of this Amendment are made on the basis of his
experience and qualifications and represent his best judgment as a
design professional familiar with the construction industry, but the
ENGINEER cannot and does not guarantee that bids or the construction
cost will not vary from opinions of probable cost prepared by him.
B. The CITY and the ENGINEER each binds himself and his partners,
successors, executors, administrators and assigns to the other party of
this Agreement and to partners, successors, executors, administrators,
and assigns of such other party in respect to all covenants of this
Amendment. Nothing herein shall be construed as creating any personal
liability on the part of any officer or agency of any public body which
may be a party hereto, nor shall it be construed as giving any rights or
benefits hereunder to anyone other than the CITY and the ENGINEER.
C. The ENGINEER agrees to initiate work promptly upon receipt of
authorization to proceed and to prosecute the work in a timely manner
until the Project is completed within 60 days from Notice to Proceed.
IN WITNESS WHEREOF, the parties hereto have made and executed this Amendment
