914-City/Cnty Investigative Bur CITY/COUNTY INVESTIGATIVE BUREAU Section 1 Revised Auqust 4, 1999 1. The CCIB shall work under the authority of the Sheriff of Seminole County, Florida, through his appointed Commander. 2. Each member agency head shall be seated as a member of the Board of Directors, Chaired by the Sheriff of Seminole County. This Board shall direct and advise the Commander of the City/County Investigative Bureau of its mission of drug enforcement, prostitution, organized crime and/or those other special investigations as directed by the Sheriff/Board of Directors. 3. The City/County Investigative Bureau shall be funded by the Sheriff of Seminole County, that he shall provide office space, vehicles and that related equipment necessary to complete the goals of the CCIB. Each seated member shall provide at least one agent and shall commit for a period of at least two (2) years. Member agencies shall share equally in any disbursement of seized monies or other assets seized by CCIB. However, members must have been actively participating (had an agent assigned) at the time of the investigation. (This paragraph subject to subsequent agreements of seated 'members.) 4. The Commander of the CCIB shall meet monthly with seated Board members and outline the monthly activities of CCIB and the involvement of his representative. He shall provide the Board members with a summary report of this activity to include significant and/or long term investigations, operations, arrests, search warrants, seizures, status of previously seized property and other information which may be requested by Board members. 5. In the event o~ a disciplinary problem, the Commander of CCIB Will handle the problem. In the event a problem is of substantive nature, and requires an internal investigation, the Commander of CCIB will notify the Director of Metro Services, who will notify the Agency Head of the agent involved. If the internal investigation involves the violation of a SCSO policy & procedure, the Sheriff's Office will be responsible for conducting the investigation. If the investigation involves a violation of only the representative agency's policy, then the representative agency will be responsible for the internal investigation, Depending on the circumstances, the Sheriff and Agency Head may elect to conduct a joint investigation or allow an outside agency to conduct the investigation. Regardless of which agency does the investigation, the results of the investigation will be presented to both the Agency Head and the Sheriff for action as they see fit. 6. All potential members (working agents) of CCIB shall be interviewed by the Commander of CCIB or his designee and a CCIB Sergeant. The recommendation of the interview board will be presented to the agency head for action. SD11453 C:\C'(.'II]',I tbI\DOCtJMENTS\GUIDELINES99.DOC DISTRIBUTION OF FORFEITURE ASSETS IMPLEMENTATION AGREEMENT Section 2 Whereas, all of the member agencies of the City/County Investigative Bureau are desirous of stemming the flow of narcotic traffic into and through Seminole County, and their specific jurisdiction, and, Whereas, Florida Statute 932.701-704, the Florida Contraband Forfeiture Act, provides that any personal property utilized in the commission of a felony may be forfeited to the use of or for sale by law enforcement agencies; and, Whereas, not all of the agencies involved in law enforcement in Seminole County have either the resources nor the expertise to pursue forfeitures; and, Whereas, certain agencies do possess these resources and are desirous of assisting all other agencies for the common good, then now, Therefore, the parties agree that the following procedures shall be utilized in the forfeiture and distribution of personal property seized by the City/County Investigative Bureau that may be subject to forfeiture: 1. Seizure of motor vehicles and aircraft: a. If any is seized with contribution of manpower or resources by the City/County Investigative Bureau, then it shall be considered subject to this Agreement. b. After a vehicle is seized by an agency and thereafter the CCIB is called upon for assistance and/or further investigation, then the participants in the CCIB shall only share in any forfeiture that may result through future seizures, but NOT the seizure of the initial vehicle. c. If the Commander of CCIB decides that the vehicle in question is suitable for forfeiture, subject to the guidelines herein, the following procedure will be followed: 1. All paperwork, consisting of all reports and/or information about the vehicle, its use during the commission of the crime, it's location, lien information, and any other pertinent information, shall be immediately forwarded to the attorney supporting CCIB for processing and consideration for forfeiture under Florida Statute 932.701-704, and if the vehicle is deemed suitable for forfeiture by that attorney, then, 2. The vehicle will be offered to a rotation list of the participating agencies, who were participants at the time of the investigation. Agencies who may join CCIB later will be placed at the "bottom of the list", as will an agency who receives a seized vehicle. 3.
