PROJECT: Marina Permitting Strategy CITY: SANFORD, A MUNICIPAL CORPORATION OF THE STATE OF FLORIDA CONSULTANT: GLATTING JACKSON KERCHER ANGLIN LOPEZ RINEHART~ INC {GLATTING JACKSON) Execution of the Work Order by CITY shall serve as authorization for the CONSULTANT to provide for the above project, professional services as set out in the Scope of Services attached as Exhibit "A," to that certain Agreement between the CITY and the CONSULTANT and further delineated in the specifications, conditions and requirements stated in the following listed documents which are attached hereto and made a part hereof. In no event shall the CONSULTANT be paid more than the Fixed Fee Amount. Payment to the Consultant shall be made by the CITY in strict accordance with the payment terms of the above-referenced Agreement. It is expressly understood by the CONSULTANT that this Work Order, until executed by the CITY, does not authorize the performance of any services by the CONSULTANT and that the CITY, prior to its execution of the Work Order, reserves the right to authorize a party other than the CONSULTANT to perform the services called for under this Work Order if it is determined that to do so is in the best interest of the CITY. Exhibit A SCOPE OF SERVICES Professional Planning, Landscape Architectural, Architectural and Engineering Services City of Sanford: P. FPS 00/01 - 8 WORK ORDER NO.: 0~8 Marina Permitting Strategy Glatting Jackson Project No. 16526.00 April 19, 2002 The following are scope and fee items to be included in the Marina Permitting Strategy work. For the scope of work outlined in this Work Order, the team members will provide the following services: Gee & Jenson (G&J) will attend meetings with FDEP and participate in strategy discussions regarding options for construction, engineering and permitting. SmithGroup (SG) will attend strategy meetings and support the team regarding master planning, construction techniques, order of magnitude cost / phasing options and funding options. Glatting Jackson. (G J) Manage, Coordinate and Review work, meet with Agencies locally and in Tallahassee, provide Memorandum of team work summarizing permitting issues and requirements, phasing options, potential funding/grant sources, and outline next steps to initiate design, permitting and construction. TEAM SCOPE OF SERVICES Part I - Define Environmental/Land Use Permitting Issues Review Submerged Land Lease - (G J) The Consultant will review submerged land lease information provided by the Florida Department of Environmental Protection. If possible, the submerged land lease area will be shown on the Marina Island Master Plan. Marina Island Presentation Materials - (GJ/SG) The Consultant will modify the Marina Island Master Plan to show the Lake Monroe navigational channel, and phasing options for the marina expansion. Data, including dredge/fill acreages and boat slip totals, will be identified for each phase. In addition to the revised Marina Island Master Plan, a true color aerial and master plan will be created which depict the relative project area position in Lake Monroe. Assess Manatee Issue - (G J) The consultant will review available data sources for information on the potential for occurrence of listed species, including manatee (Trichechus manatus) populations in the Lake Monroe Area. Comparisons of manatee mortality will be developed for Lake Monroe versus other areas, such as Volusia, Brevard and Lee Counties. o Develop Story - (GJ/SG) The consultant will develop a story board showing the history and context of Sanford as a port city over the last 150 years, and indicating the St. Johns River's designation of American Heritage status. This board will support relevant points for the return of the marina to its historical level of importance, thereby revitalizing downtown Sanford. 10. Florida Department of Environmental Protection (FDEP) - (GJ/G&J) The Consultant, Client and project engineer will meet with Ms. Vivian Garfein, with the local FDEP office, to review phasing options for marina expansion. This meeting is critical to defining environmental, engineering, and survey requirements for the permit application submittal. Specifically, the following issues will need to be further defined: · Progression of conceptual/construction permit versus sovereign land applications · Based on current data, the extent of the Manatee issue · Details on the FDEP's role in assessing Development of Regional Impact (DRI) projects. · Special engineering requirements, such as water circulation studies, etc. · Requirements for bathometry of basin expansion areas and channel · Market analysis to support marina expansion Land Use Entitlements - (G J) Meet with Greg Golgowski of the East Central Florida Regional Planning Council to determine how DRI thresholds affect the phased marina expansion. Since the FDEP Tallahassee will assume these responsibilities later this year, the consultant will also coordinate with that office to determine how to mesh DRI issues with DEP permit issues. These meetings will define the DRI process for marina expansion. United States Army Corps of Engineers (ACOE) - (GJ/G&J) The consultant will meet with the ACOE to determine permitting issues. Primary issues include dredge/fill (Section 10 of the 1899 Rivers and Harbors Act) and navigation. Define Strategic Phasing - (Team) Subsequent to the pre-application meetings, the consultant and project engineer will meet with the Client in a workshop setting to discuss the optimal first phase and develop details of each marina expansion phase. These details will include the following: · Master Plan showing each phase and optimal slip arrangement · Permit requirements (FDEP, DCA and ACOE) · Engineering, survey and environmental data needs · Details for consulting and construction costs · Identify funding options Consultant team will attend two workshop sessions with the Client to review information gathered from permitting meetings, and discuss/draw scenarios for expansion permitting, design and master planning. These meetings will be summarized in a Memorandum. The Consultant envisions one strategy session after the local meetings, and one after the Tallahassee meeting listed below. The Consultant will also provide a Summary Outline of possible grant/funding sources for marina improvements. This shall include State and Federal programs which may apply. Meeting with FDEP, Tallahassee - (GJ/G&J) The Consultant shall attend one meeting with Mr. Denver Stutler, FDEP and his staff to review local meetings, conceptual approaches, etc for the Marina. Discussion shall specifically include Permitting, Phasing, Land Lease and DRI issues. Action Plan. (Team) At the conclusion of all agency and team meetings, the Consultant shall draft an action plan Memorandum summarizing findings and recommended next steps or options to proceed. Concept Plans, budgets, meeting notes and other materials produced during the work shall be attached. Part II Additional Services 11. Additional Services - (Team) This may include additional meetings, survey, field investigation, permitting, market assessment or design/construction detailing. These details will be provided subsequent to the completion of Part I. Project Management [Glatting Jacksonl - In addition to the specific services detailed above, Glatting Jackson shall coordinate our with the Client's representative and the Client's project team, monitor the project schedule as it relates to this scope, and provide timely invoicing and reporting of project progress. Coordination of the Work of Subconsultants to Giatting Jackson - The Client hereby acknowledges and agrees that Glatting Jackson will assume responsibility for the coordination of work produced by any subconsultants to Glatting Jackson as Project Manager for the project. However, the Client agrees that Glatting Jackson does not bear any liability for the technical accuracy of work prepared by others. All professional firms working on the project shall bear separate responsibility and liability for the work prepared by them. Client Responsibilities - The client shall designate a Project Representative immediately upon execution of this Letter of Agreement, who shall be Glatting Jackson's point of contact with the Client, and who shall, by virtue of Client's designation, have authority to bind the Client. The Client shall provide full information to Glatting Jackson regarding project requirements and constraints including, without limitation, a program setting forth the Client's objectives, and shall provide all data, drawings, information or other resources requested by Glatting Jackson that are necessary for completion of the project. This shall include all available existing information regarding land leases, easements, Lake Monroe basin survey data, or other information regarding the marina or surrounding submerged lands. The Client shall comply with any schedule requirements made known to the Client by Glatting Jackson and, in any event, shall be available to meet with Glatting Jackson and provide decisions in a timely manner throughout the project.
