1128-MOU-Law Enforcement ActiviMEMORANDUM OF UNDERSTANDING RELATING TO CITY OF SANFORD LAW ENFORCEMENT ACTIVITIES T4!s MEMORANDUM OF UNDERSTANDING (the "MOU ") is entered into this 51 day of 2006 by and between the Sanford Airport Authority, a dependent special district existing under the provisions of Chapter 71 -924, Laws of Florida, ( the Authority), whose address is 1200 Red Cleveland Boulevard, Sanford, Florida 32773, and the City of Sanford Police Department, a local law enforcement agency, (the Sanford Police), whose address is C/O City Manager, City Hall, 300 North Park Avenue, Sanford, Florida 32771. WHEREAS, the Attorney General of the State of Florida issued Attorney General Advisory Opinion Number AGO 2003 -04 on February 12, 2003 and opined that the SAA " . .. is authorized by section 11(4)(f), Chapter 71 -924, Laws of Florida, and section 332.08(2)(a), Florida Statutes, to create its own airport guards or police with full police powers within the territorial limits of the airport authority district' and WHEREAS, the SAA exercises non - exclusive law enforcement authority within the limits of the Orlando Sanford International Airport; and WHEREAS, the Sanford Police exercise law enforcement authority within the City Limits of the City of Sanford in accordance with the provisions of Florida law; and WHEREAS, the SAA and the Sanford Police desire to set forth an understanding relating to the scope and effect of their respective jurisdictional responsibilities. NOW, THEREFORE, in consideration of the foregoing recitals, and for the other good and valuable consideration, the receipt of which is acknowledged by execution of this MOU, the parties agree and understand as follows: (1). The above recitals are true and correct and form a material part of this MOU upon which the parties have relied. (2). All SAA law enforcement officers shall have jurisdiction to conduct law enforcement activities within the limits of the Orlando Sanford International Airport except in "fresh pursuit' activities in which cases the SAA law enforcement officers may act in accordance with the controlling provisions of State law, but, in any, event shall coordinate their activities with the appropriate personnel of the Sanford Police. (3). The SAA and the Sanford Police desire to cooperate and coordinate with regard to their respective activities and to collaborate in the protection of the public health, safety, morals and welfare and to ensure homeland security and the advancement of the public interest. (4). The undersigned signatories represent that they have the lawful authority to enter into this MOU on behalf of the respective parties. (5). This MOU shall be in effect on the date that it is executed by both of the parties hereto.
